APPROVAL OF CERTIFIED SURVEY MAP

WHEREAS, A certified survey map was submitted on Januaty 5,2002 to finalize a two-
lot land division of the Schweitzer property located on Ryan Road in the SE % of
Section 23; and
WHEREAS, The Plan Commission adopted Resolution #P.C. 004-2002 recommending
approval.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego, upon the recommendation of the Plan Commission, does hereby approve the
certified survey map to finalize a two-lot land division of the Schweitzer property on
Ryan Road in the SE % of Section 23 subject to the conditions outlined in Resolution
#P.C. 004-2002.
BE IT FURTHER RESOLVED That this approval is subject to receipt of all fees required
by Section 18.14 of the Land Division Ordinance, any special assessments which may
be due, approval of the City Engineer, and passage and publication of Ordinance
#I 088.
0 BE IT FURTHER RESOLVED That a digital '.DXF file, '.DGN file, or *.DWG file of this
Certified Survey Map be submitted to the City prior to City signatures being placed upon
the CSM (3-112'' diskette) and all information transmitted on the diskettes shall be tied
to and referenced to State Plane Coordinates NGVD 1929 or others approved by the
City Engineer

Petitioners seek to divide property located on Ryan Road for the purpose of creating one new parcel. The certified

The 2010 Plan calls for the area to be low density residential. However, the
entire neighborhood is currently medium density residential. The proposal is not
consistent with the Plan. However, staff believes this was an oversight in the
2010 Plan, as the Committee made every effort to keep existing properties
conforming. Staff has scheduled a public hearing to amend the Plan. The Plan
revision should not delay the approval of this CSM.
The properties are zoned RS-2 Suburban Residence District, requiring 20,000
are 15 feet and 20 feet. The parcels are conforming to the Code.

centerline.

RECOMMENDATION OF APPROVAL OF A CERTIFIED SURVEY
MAP FOR A TWO (2) LOT LAND DIVISION FOR THE
SCHWEITZER PROPERTY LOCATED IN THE SE '/4 OF SECTION 23
(TAX KEY NO. 2252.932 / S94 W14140 RYAN ROAD)
WHEREAS, On January 5, 2002 a certified survey map was submitted by Larry
Schweitzer for a two (2) lot land division of the Schweitzer property located in the
SE '/4 of Section 23, and
WHEREAS, Said property is zoned RS-2 Suburban Residence District, requiring
a minimum lot size of 20,000 square feet and an average minimum width of 110
feet, and said lots meet said minimum zoning requirements, and
WHEREAS, The 2010 Comprehensive Plan depicts this area for low density
residential development and a Public Hearing has been scheduled for February
12, 2002 to amend the Plan to depict the entire area bounded by Groveway
Lane, Ryan Road and Boxhorn Drive as medium density residential, in order to
be consistent with existing zoning and sanitary sewer planning, and
a WHEREAS, Said parcels will be serviced by City sewer and will access water
through private systems, and
THEREFORE BE IT RESOLVED, That the Plan Commission recommends
approval to the Common Council of a Certified Survey Map for a two (2) lot land
division of the Schweitzer property located in the SE % of Section 23 subject to
resolution of technical discrepancies as identified by the City Planning
Department and City Engineers, and payment of all applicable fees in Section
18.14(3) of the Land Division Ordinance and outstanding assessments if
applicable.
BE IT FURTHER RESOLVED, That a *.DXF file of this CSM be submitted to the
City prior to City signatures being placed upon the CSM (3-1/2" diskette).
