APPROVAL OF CERTIFIED SURVEY MAP

WHEREAS, A certified survey map was submitted to finalize a two-parcel land division
of the Kaebisch property located on Racine Avenue and Parker Road in the NW % of
Section 29; and
WHEREAS, The Plan Commission adopted Resolution #P.C. 220-2000 recommending
approval.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego, upon the recommendation of the Plan Commission, does hereby approve the
certified survey map to finalize a two-parcel land division of the Kaebisch property
located on Racine Avenue and Parker Road in the NW % of Section 29 subject to the
conditions outlined in Resolution #P.C. 220-2000.
BE IT FURTHER RESOLVED That this approval is subject to receipt of all fees required
by Section 18.14 of the Land Division Ordinance, any special assessments which may
be due, approval of the City Engineer and adoption of Ordinance #IO55 to rezone the
property from WOOS to A.
BE IT FURTHER RESOLVED That a digital *.DXF file, *.DGN file, or *.DWG file of this
Certified Survey Map be submitted to the City prior to City signatures being placed upon
the CSM (3-1/2" diskette) and all information transmitted on the diskettes shall be tied
to and referenced to State Plane Coordinates NGVD 1929 or others approved by the
City Engineer

RECOMMENDATION TO COMMON COUNCIL TO REZONE PROPERTY FROM EA / 00s 0 EXCLUSIVE AGRICULTURE DISTRICT WITH OFFICE AND SPECIAL SERVICE OVERLAY
MAP FOR A TWO (2) LOT LAND DIVISION FOR THE KAEBISCH PROPERTY LOCATED IN
THE NW % OF SECTION 29

DISTRICT TO A -AGRICULTURE DISTRICT, AND APPROVAL OF A CERTIFIED SURVEY
WHEREAS, A certified survey map was submitted by Laurel Kaebisch for a two (2) lot land
division of the Kaebisch property located in the NW % of Section 29 (Racine Avenue I Tax Key
No. 2274.997.001), and
WHEREAS, Said Certified Survey Map substantially conforms to that of the Plan Commission's
previously approved sketch review, under Resolution #P.C. 220-2000, and
WHEREAS, Said property is proposed to be rezoned from EA / 00s Exclusive Agriculture
District with Office and Special Service Overlay District to A - Agriculture District, requiring a
minimum lot size of 2.75 acres and an average minimum width of 300 feet, and said lots appear
to meet said minimum zoning requirements, and
WHEREAS, The adopted Comprehensive Plan depicts this area for rural and agricultural use,
and the proposal is consistent with the Plan, and
WHEREAS, Parcel 1 is proposed to remain in agricultural use at this time, and therefore soil
and
tests for private on-site sewer have not been provided, and wetlands have not been delineated,
WHEREAS, Parcel 2 will be serviced by private on-site sewer and water facilities, and
WHEREAS, A grading plan has not been submitted for Parcel 2, and
WHEREAS, Access to Racine Avenue is subject to the approval of the Waukesha County
Department of Transportation.
THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the
Common Council of a Certified Survey Map for a two (2) lot land division of the Kaebisch
property located in the NW '/4 of Section 29 subject to resolution of technical discrepancies as
identified by the City Planning Department and City Engineers, and payment of all applicable
fees in Section 18.14(3) of the Land Division Ordinance and outstanding assessments if
applicable.
BE IT FURTHER RESOLVED, That the Plan Commission approval of the Certified Survey Map
is conditioned upon the receipt of access permits from the Waukesha County Department of
Transportation.
BE IT FURTHER RESOLVED, That no building permits shall be issued for Parcel 1 until such
parcel may be suited for an on site sanitary system, and until such time that any wetlands which
time that soil tests have been received by the Planning Department which indicate that the
may be located on the property are delineated and the Planning Department is in receipt of

City Engineer prior to the issuance of building permits for Parcel 2.

Overlay District to A - Agriculture District.
