APPROVAL OF CERTIFIED SURVEY MAP

WHEREAS, A certified survey map was submitted on July 14, 2000 to finalize a two-
parcel land division of the Johnson property located on North Cape Road in the NE %
of Section 25: and
WHEREAS, The Plan Commission adopted Resolution #P.C. 159-2000 recommending
approval.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego, upon the recommendation of the Plan Commission, does hereby approve the
certified survey map to finalize a two-parcel land division of the Johnson property
located in the NE % of Section 25 on North Cape Road subject to the conditions
outlined in Resolution #P.C. 159-2000.
BE IT FURTHER RESOLVED That this approval is subject to receipt of all fees
required by Section 18.14 of the Land Division Ordinance, any special assessments
which may be due, and approval of the City Engineer
BE IT FURTHER RESOLVED That a DXF or DGN file of this CSM be submitted to the
City prior to City signatures being placed upon the certified survey map (3 %” diskette).

APPROVAL OF A TWO (2) LOT CERTIFIED SURVEY MAP FOR THE JOHNSON
PROPERTY LOCATED IN THE NW % OF SECTION 25
(TAX KEY NO. 2257.996 / W126 S9555 NORTH CAPE ROAD)
WHEREAS, On July 14, 2000 a certified survey map was submitted by David Johnson
for a two (2) lot land division of the property located in the NW % of Section 25, (Tax
Key No. 2257.996 / W126 S9555 North Cape Road), and
WHEREAS, The proposed land division would create lots with a minimum area of
17,772 square feet and an average minimum width of 145 feet, and
WHEREAS, Said property is zoned RS-3, Suburban Residence District, requiring a
minimum lot size of 15,000 square feet and an average minimum width of 100 feet, and
parcels appear to meet said minimum zoning requirements, and
WHEREAS, The adopted Comprehensive Plan depicts this area as being set aside for
medium density residential development and this proposal is within this goal, and
WHEREAS, The adopted 2010 Highway System Plan depicts North Cape Road to have
an ultimate right-of-way width of 100 feet, and Ryan Road to have an ultimate right-of-
way width of 80 feet, and such dedications of land are depicted on the submittal, and
WHEREAS, Said parcels will be serviced by City sewer and private water
THEREFORE BE IT RESOLVED, That the Plan Commission approve of a Certified
Survey Map being submitted creating a two (2) lot land division of the Johnson property
in the NW % of Section 25 subject to resolution of technical discrepancies as identified
by the City Planning Department and City Engineers, and payment of all applicable
fees in Section 18.14(3) of the Land Division Ordinance and outstanding assessments
if applicable.
BE IT FURTHER RESOLVED, That a digital *.DXF file, '.DGN file, or *.DWG file of this
Certified Survey Map be submitted to the City prior to City signatures being placed
upon the CSM (3-1/2" diskette) and all information transmitted on the diskettes shall be
tied to and referenced to State Plane Coordinates NGVD 1929 or others approved by
the City Engineer

TO DISCONTINUE AND VACATE
A ROAD RIGHT-OF-WAY IN THE
CITY OF MUSKEGO, WISCONSIN
RESOLUTION
BE IT RESOLVED by the Common Council of the City of Muskego, Wisconsin, as follows:
That since the public interest requires it, the whole of the following described real estate in the
City of Muskego, Wisconsin, be and is hereby discontinued and vacated as a street, to wit:
of Section 26. Town 5 North, Range 20 East, City ofMuskego, Waukesha County, Wisconsin, bounded and
Being all that part of Parcel 1 and Outlor 1 of Certified Survey Map No. 8412. Also being a part of the Southeast %
described as follows:
Commencing at the Northwest corner of the Southeast one-quarler of aforesaid Section 26; thence S 01" 04' W'E,
1331.685 feet along the west line of said Southeast one-quarter of Section 26 to the northwest corner of Outlot 1 of
to the Northeast comer thereof and the point of beginning of the lands hereinafrer described; thence continuing along
foresaid CSM No. 8412; thence N 88" 55' 43" E, 319.57 feet along the North line of Outlot 1 of said CSM No. 8412
the North line of Parcel 1 of said CSM No. 8412 N 88" 55' 43" E, 30.00 feet; thence S 01" 04' 09" E, 245.20 feet to
the North line of CSM No. 3909; thence S 88" 55' 5 I" W, 60.00 feet along the Norlh line of CSM No. 3909 and rhe
westerly extension thereof; thence N 01" 04' 09" W, 245.20 feet along a line 30' westerly of and parallel to the
easterly line of Outlot 1 of aforesaid CSM No. 8412 to the northerly line of said Outlot I; thence N 88" 55' 43" E.
30.00 feet along the north line of Outlot 1 of said CSM No. 8412 to the point of beginning, containing 0.3377 AC

That the street discontinued and vacated by this Resolution is designated in red on a map hereto
annexed, made a part hereof and marked Exhibit "A."
