CCR1998232AMENDED COMMON COUNCIL -CITY OF MUSKEG0 RESOLUTION #232-98 AMENDMENT TO SUBDIVIDER'S AGREEMENT LAKEWOOD MEADOWS ADDITION #2 WHEREAS, The Common Council of the City of Muskego through Resolution MO-97, as amended and adopted on March 25, 1997, approved the Subdivider's Agreement for Lakewood Meadows Addition #2; and WHEREAS, Section XI1 of the Lakewood Meadows Addition #2 Subdivider's Agreement dated June 1 1, 1998 permits two model homes to be built; and WHEREAS, The Developer has requested an amendment to the agreement to increase the number of model homes permitted from two to four; and WHEREAS, The Finance Committee has reviewed and recommended approval NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of Muskego, upon the recommendation of the Finance Committee, does hereby approve the amendment to the Subdivider's Agreement. Sadowski, AICP, Director of Planning DATE: November 20, 1998 RE: Lakewood Meadows Addtn #2 Subdivider's Agreement Model Home Permits This Office has received a request from Peter Barrette of Lakewood Development Group requesting that we allow four lots within Lakewood Meadows Addtn #2 to be released for building permits at this time. To date the subdivision has not been released for general building permits due to the need to complete certain check list items such as: certify lot grades, televise sanitary sewers, clean storm sewers, safe water test. In these situations, the Subdivider's Agreement typically provides for two model home permits to be issued prior to the completion of these items. 0 As indicated above Mr Barrette is requesting that his Subdivider's Agreement be amended to allow and additional two model home permits to be issued. The reason being is that he has four parties wishing to begin construction on their homes. It is my understanding that the parties wish to begin construction before the end of the year It is not clear that all check list items can be addressed in this same time frame. As is standard with the model home agreements, no occupancy permits would be issued until such time as the check list is satisfied. Lot 36. 45, 44, and 47 The requirements that are set forth in the Developer’s Agreement appear to have been satisfied with the exception of the erosion control that will be addressed this following week^ Satisfsction of the terms of the Developer’s Agreement should be complete since “As Built” plans have been provided to the City from Metropolitan Engineering Any help in an expedient approval of these. limited number of lots would allow us to saris@ a few lot owner’s needs and take a little pressure off both of our offices Thank you in advance for your prompt attention to this matter cc: File Larry Galeener
