CCR1998016COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #16-98 PRELIMINARY RESOLUTION DECLARING INTENT TO EXERCISE SPECIAL ASSESSMENT POLICE POWERS UNDER 566.60 WI STATUTES AS TO SANITARY SEWER ASSESSMENT (Project MSS-2-98; Assessment District "SR") AREA FOR MARTIN DRIVE SEWER PROJECT RESOLVED by the Common Council of the City of Muskego, Wisconsin: 1. 2. 3. 4. 5. 6. The Common Council hereby declares its intention to exercise its police power under 566.60, Wisconsin Statutes, to levy described area for special benefits conferred upon such special assessments upon property within the following property by installation of the sanitary sewers in streets abutting the following property: Martin Drive Sewer Project (Project MSS-2-98; Assessment District "SR") See Attached Map and Legal Description The Common Council determines that the improvements constitute an exercise of the police power and the amount assessed against each parcel shall be based on front foot and/or unit basis. The assessment against any parcel may be paid in cash or in annual installments. The City Engineer shall prepare a report which shall consist of: A. Final plans and specifications for the improvements. B. An estimate of the entire cost of the proposed sewer improvement project. C. Schedule of proposed assessments. When the report is completed, the City Engineer shall file a copy of the report with the Clerk-Treasurer for public inspection. Upon receiving the report of the City Engineer, the Clerk-Treasurer shall cause notice to be given stating the nature of the proposed improvement, the general boundary thereof, the time and place at which the report may be lines of the proposed assessment area, including a small map inspected, and the time and place of the public hearing on the matters contained in the Preliminary Resolution and the report. This notice shall be published as a Class 1 Notice and a copy shall be mailed at least ten (10) days before the hearing to every interested party. Resolution #16-98 Page 2 7. Some of the proposed assessments may or may not be deferred by further action of the Common Council. 8. The hearing shall be held at City Hall at a time set by the Clerk-Treasurer in accordance with §66.60(7), Wisconsin Statutes. DATED THIS 21th DAY OF JANUARY , 1998. The following Alderpersons were present: The following Alderpersons were absent: The Mayor opened the meeting by announcing that this was an open meeting of the Common Council. Notice of this meeting was given to the public at least 24 hours in advance of the meeting by forwarding the complete agenda to the official City newspaper, the Muskeso Sun, and to all news media who have requested the same as well as posting. Copies of the complete agenda were available for inspection at the City Clerk's office.
