CCR1997107COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #107-97 DETERMINATION OF NONSUBSTANTIAL CHANGE TO ORIGINAL OPD FOR MUSKEG0 REGENCY WHEREAS, the original Overlay Planned Development (OPD) of Muskego Regency Retirement Community approved ten 8-unit buildings, one 10-unit building, two 32-unit buildings and one 96-unit building; and WHEREAS, Wimmer Brothers has submitted a revised site plan which proposes to eliminate four of the 8-unit buildings and the one and 10-unit building and proposes to construct one 42-unit building; WHEREAS, the Plan Commission has recommended that this change does not constitute a substantial alteration of the original approved OPD of Muskego Regency Retirement Community as the unit densities remain the same while the open space increases; and WHEREAS, the Plan Commission has found that the submittal does Muskego Regency Retirement Community and the petitioner will be represent a substantial change to the Conditional Use Grant for directed to file for a public hearing to be held before the Plan Commission and to submit all applicable documentation prior to Resolution. the public hearing being held subject to the outcome of this NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego, upon the recommendation of the Plan Commission, does hereby determine that the proposed change as identified above does not constitute a substantial change to the original overlay planned development of Muskego Regency Retirement Community and a public hearing before the Common Council is not by the Plan Commission. required, however, petitioner must meet the conditions outlined DATED THIS 13th DAY OF MAY , 1997.
