AMENDED RELOCATION ORDER OF THE CITY OF MUSKEGO,
WAUKESHA COUNTY, WISCONSIN
(Durham Drive Lift Station/Hi View-Holz Project- Benke/Buechel)
NOW COMES the City of Muskego, Waukesha County, Wisconsin, by its
Common Council and for its Amended Relocation Order hereby resolves as
follows

That this Resolution is an amendment to a Relocation Order
which is Resolution #257-96 which was passed and approved on
November 12, 1996;
That this Resolution is an Amended Relocation Order in
accordance with §32 05(1), Wisconsin Statutes, for the
purposes of the within described public improvement project
and it is also a determination of necessity for that project
in accordance with §32.07(2), Wisconsin Statutes;
That the City of Muskego hereby determines that it is a
necessary and public purpose to construct sanitary sewers
for sewer improvements as shown on the maps attached hereto,
made a part hereof and marked Exhibits "A-1" through "A-3";
That said sanitary sewer will be built as set forth on the
maps which are annexed to this Amended Relocation Order as
Exhibits "A-1" through "A-3";
That the sites of said sanitary sewer are contained in
Exhibits "A-1" through "A-3" which are annexed to this
Amended Relocation Order; that legal descriptions to said
marked Exhibits "B-1" through "B-4";
sites are attached to this Amended Relocation Order and
That the City of Muskego will acquire fee simple title as to
Exhibits "A-1" and "B-l'c, a permanent easement as indicated
on Exhibits "A-2" and "B-2" and other necessary temporary
access drive easements as indicated on Exhibits "A-3" and
"B-3" and "B-4" for sanitary sewer improvements all of which
are attached to this Amended Relocation Order.
Passed and approved this 25th day of February , 1997.
I hereby certify that on the 25th day of February , 1997, the
within Amended Relocation Order was adopted by a vote of 7 ayes to
0 nays by the Common Council of the City of Muskego, Waukesha
County, Wisconsin

All that part of the Northeast and Northwest 1/4 of the Southwest 1/4 of Section 13, Town
5 North, Range 13 East, City of Muskego, Waukesha County, Wisconsin, more fully
described as follows:
Being a 2.5.00 foot wide strip of land the centerline of which would be within 50.00 feet of
the following described line:
Parcel Two:
Commencing at the Southwest comer of Parcel 3, CSM No. 7979; thence Northwesterly
along the East line of Holz Drive 50.00 feet; thence Northeasterly to a point on the East
line of said Parcel 3 being 100.00 feet North of the Southeast comer of said Parcel 3 and
the point of beginning; thence continuing Northeasterly through Tax Key Number
221 1.999 to a point on the West line of Durham Drive and the point of termination, said
point being 390.00 feet more or less Southeasterly of the intersection of the South line of
Holz Drive and the West line of Durham Drive.
Said strip of land subject to field staking prior to construction and shall be altered by the
City as needed to avoid wetlands, as to be delineated, and large trees.
