CCR1997037COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #37-97 RESOLUTION INDICATING CITY'S PRESENT INTENT TO APPROVE THE CONCEPT OF RS-2/0PD ZONING Miller Development WHEREAS, Glen Miller, agent for property owner, Don Miller, has petitioned the Council to rezone property located in the SW 1/4 of Section 5 from R-2 to RS-2/0D to allow for the development of of the property for four proposed duplex structures; and WHEREAS, a public hearing has been held; and WHEREAS, the Plan Commission has recommended an OPD designation be placed on the property due to the lot configuration to provide flexibility to the developer with respect to building placement and control by the City with respect to landscape and building design and open space preservation; and WHEREAS, the City wishes to indicate its present intention of approving the concepts which so far have been presented by the owner and wishes to defer acting on the rezoning until all developments have been met. requirements of the City's ordinances pertaining to planned unit NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego does hereby indicate its present intention that and defers acting on the rezoning request to RS-2/0PD until all it approves of the concept of the project proposed by Mr. Miller developments have been met. requirements of the City's ordinances pertaining to planned unit BE IT FURTHER RESOLVED that this deferral is with the agreement of the petitioners.
