CCR1996288AMENDED COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #288-96 APPROVAL OF CONTRACT FOR RESCUE SERVICE WHEREAS, it is necessary that the City of Muskego and the Tess Corners Volunteer Fire Department enter into a contract for rescue service for the City's residents; and WHEREAS, the attached contract has been recommended for approval by the Finance Committee. NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego, upon the recommendation of the Finance Committee, does hereby approve the contract for rescue service between Tess Corners Volunteer Fire Department and the City of Muskego for a fee of $215.00 per rescue call beginning January 1, 1997 for five years subject to insurance to have a minimum liability for bodily injury of $1,000,000 combined single limit. Resolution #288-96 which was adopted by the Common Council of the 12/96 jmb Tess Corners Volunteer Fire Department Rescue Service This contract made and entered into this first day of January 1997 by and between the Tess Corners Volunteer Fire Department, hereinafter referred to as the Fire Company and City of Muskego, a municipal corporation of Waukesha County, Wisconsin, hereinafter referred to as Muskego. Witnesseth: Whereas, the parties hereto are desirous of entering into an agreement whereby the fire company will furnish rescue and first aid services to a1 1 areas of the City of Muskego lying within the 1 imi ts of the City of Muskego upon the terms and conditions hereinafter more particularly s2t forth. Now, therefore, in consideration of the mutal covenants and promises of' each of the parties hereto and for other good and valuable consideration each to the other paid, the receipt of which is hereby acknowledged, the parties hereto do hereby covenant and agree, each with the other, as follows: 1. The fire company agrees to immediately furnish upon request the sxvices of their rescue truck apparatus, equipment and personRe1 -to promptly. aoswer and respond to rescue call s coming from and pertaining to emergencies located within the City of Muskego. 2. The Fire Company agrees to keep and .maint?i.n j.n good. workiog:oFdec. and:, repair, properly housed at all times and at their sole cost and expense their rescue truck, apparatus, and equipment and to keep trained personne1:available and on call to man same. 3. The Fire Company further agrees to maintain adequate 1 iabil ity insurance with the limits of said policy not to be less than $200,000.00 and $500,000.00 each occurence and that the city be furnished a copy of said policy. 4. It is distinctly understood by all parties that the rescue service contracted for in this agreement is for emergency purposes only and that tne Fire Company wi 11 not transport patients to hospitals unless there is a true emergency as determined by the Fire Company official in charge of the rescue truck at the time of the call. 5. The Fire Company shall keep and accurate and full report on all rescue calls made and shall at least once a month submit such report tc the City Clerk of The City of Muskego. . , . servin5 the community srnce 1926 . . . As consideration for the foregoing covenants and agreements and services to be rendered and performed by the Fire Company, Muskego agrees to pay the Fire Company and Fire Company agrees to accept the following payments. $215.00 per rescue call. 7. This contract can be revised with an escalator clause not to exceed 8% per year in addition to rescue fees any monies collected for supplies or extra service shall be retained by city. 8. This contract shall commecne as of the 1st day of January 1997 end shall remain in full force and effect for a period of five years from said date, unless either of the parties hereto shall give to the other written notice of it desire to cancel and terminate samem December 31st of any year, such notice to be forwarded by registered mail at least thirty (30) days prior. to the expiration. 9. The Common Law rules-of 1 iabil ity require that the rescue squad use reasonable care in seeing to the safety and well being of the patient under the specific circumstance involved.' 0 10. The escalator clause will not be in effect unless we notify 90 days in advance of January 1st of calendar year. 11. The City of Muskego will be charged 50% for no transports.
