RESOLUTION #239-96
RESOLUTION TO AMEND THE OVERLAY PLANNED DEVELOPMENT
OF THE MEADOW GREEN WEST ADDITION NO. 2 SUBDIVISION
(Redelineation of Wetland Boundaries)
WHEREAS, a Final Plat was approved for the Meadow Green West
Addition No. 2 Subdivision which illustrated a wetland area
affecting a large portion of Lots 98 through 108; and
WHEREAS, it has since been determined independently and by the
Army Corps of Engineers and Department of Natural Resources that
portions of the subject properties are no longer considered to be
wetlands due to changes in the hydrology and vegetative character
of the the parcels in question; and
WHEREAS, Boehm Construction has petitioned to amend the OPD
wetlands delineation as illustrated on the Final Plat; and
district of Meadow Green West Addition No. 2 to amend the
WHEREAS, on September 10, 1996, the Common Council determined
that the specific alterations to the wetland delineation on Lots
98, 100 and 102 requested by the petitioner were nonsubstantial 0 and did not require a public hearing; and
WHEREAS, on September 10, 1996, the Common Council determined
that the proposed overall alterations to the wetland delineations
on Lots 98 through 108, and Lots 118, 119, 120, and 121 requested
by the petitioner constituted a substantial alteration to the
original plan and that a public hearing was necessary; and
WHEREAS, the Plan Commission has recommended approval of the
proposed amendment to the OPD of Meadow Green West Addition No. 2
amended.
subject to the conditions outlined in Resolution #P.C. 201-96, as
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego, upon the recommendation of the Plan Commission,
does hereby amend the Meadow Green West Addition No. 2 OPD to
amend the wetlands delineation and subsequent construction of
homes on Lots 98 through 108, Lots 118, 119, 120 and 121.
BE IT FURTHER RESOLVED that the petitioner shall cause a document
with the Final Plat for Meadow Green West Addition No. 2 which
to be filed with the deed for the subject properties as well as
said document shall be filed with the Register of Deeds for
indicates the change in wetland boudaries in the Final Plat;
Waukesha County.
BE IT FURTHER RESOLVED that prior to the issuance of a building
permit for subject properties, copies of all documents filed with
City.
the Waukesha County Register of Deeds shall be provided to the
Resolution #239-96
until the City receives payment of all outstanding bills
BE IT FURTHER RESOLVED that the amendment will not go into effect
regarding this matter from the petitioner.
