AUTHORIZE EXECUTION OF THE 1996-1998 LABOR AGREEMENT
Telecommunicators Unit
BETWEEN LOCAL 2414 AFSCME AND THE CITY OF MUSKEG0
WHEREAS, a settlement has been reached between the negotiators
for the City of Muskego and the negotiators for the City Hall/
Telecommunicators Unit of Local 2414, AFSCME.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego, upon the recommendation of the Negotiating
Committee, does hereby authorize the Mayor and Clerk-Treasurer to
Telecommunicators Unit of Local 2414, AFSCME, and the City of
execute the settlement agreement as attached between the
Muskego for the period of January 1, 1996 through December 31,
1998, including the Letter of Understanding dated October 22,
the Agreement by the members of the Telecommunicators Unit.

Tentative Agreement
Dated: October 1, 1996
The parties have agreed to a new collective bargaining agreement adopting the provisions
of the prior contract except as set forth below:
1. Article 111 - Probationarv Period
Section 3.01 amend to read: "All newly hed employees shall be considered probationary
for the sixty (60) days work in their employment. An additional sixty (60) days worked
extension of the probationary period may be allowed if requested by the City after conference
with Union."
2. Article VI - Pav Period
Amend Section 6.01 to read: "Employees as of January 1, 1985, shall be paid bi-weekly.
Employees hued after said date shall also be paid bi-weekly except for each bi-weekly pay
period, the City shall pay each employee on Thursday for work performed through the previous
Friday."
3. Article IX - Holidav
Add the following sentence to the end of Section 9.01, "To be paid with the last paycheck
of the year."
4. Article XI - Time Off for Funerals
Add to Section 11.01, "In the event of funerals out of town (more than 250 miles) an
additional one (1) day of absence with pay shall be granted."
5. Article XV - Sick Leave
Section 15.01 Amend "one hundred thirty (130) days" to "two thousand (2,000) hours"
6. Article XVI - Vacations
Section 16.01 to read as follows: "The hiring date of all employees shall be converted to
the first day of the month (see following formula) and the resulting date shall be used to
determine the amount of vacation they are entitled to."

Amend Article to read as follows:
"Section 23.01. Any grievance or misunderstanding which may arise between the
Employer and employee (or employees) or the Employer and the Union shall be handled as
follows:
STEP 1: The aggrieved employee, the Union Committee andor the Union
representative shall present the grievance to the Department Head within sixty (60)
calendar days of the date the employee knew or should have known of the
occurrence of the event causing the grievance or misunderstanding.
STEP 2: If a satisfactory settlement is not reached as outlined in Step 1 within one
(1) week, the Union Committee andor the Union Steward shall present the
grievance in writing to the Finance Committee of the Common Council. A meeting
shall be held within two (2) weeks of the receipt of the written request from the
orher party
STEP 3: If a satisfactory settlement is not reached as outlined in Step 2, either
party may request that the matter be submitted to arbitration. If the parties cannot
agree on the selection of an arbitrator, the parties shall request the Wisconsin
Employment Relations Commission to name one. The Arbitrator shall make a
decision on the grievance which shall be final and binding on both parties. Only
issues relating to the interpretation, application, or enforcement of the terms of this
Agreement shall be subject to the arbitration procedure.
Section 23.02. The time limits mentioned above may be extended by mutual consent of

Section 23.03. The cost of the arbitrator and any other expenses shall be shared equally
by the parties."
8. Article XXVIII - Termination or Amendment of Ameement
Section 27.01. Amend to read as follows: "Either party may request amendment to th~s
Agreement by notifying the other party in writing by October 1, 1998."

14. Additional Waqe Increase
Either party may notify the other by 12/31/97, of the
desire to discuss additional pay increases beyond the 3.5% ATB
called for in 1998. Additional pay increases in 1998 (beyond
the 3.5% ATB called for in the agreementj will only become
effective if voluntary mutual agreement is reached between the
parties. This provision is for 1998 only and is not subject to
the status quo doctrine.

secretary effective upon ratification of this agreement.
16. Upon ratification the seven (7) employees (four
Telecommunicators, One Court Clerk, Two Clerks) involved with

In the course of negotiarions, the parties have agreed to delete the one-half (X) day Good
Friday holiday and replace it with a one-half (%) day Spring holiday. The parties have agreed
that this half-day Spring holiday will coincide with the Friday of the week in whch the Muskego
area school's Spring recess presently commences. The Contract specifically sets forth these dates
through 1998.
In anticipation of the possibility, however slight, that the parties will be unable to reach
agreement on a successor collective bargaining agreement prior to the Spring holiday for 1999

RE: Wisconsin Retirement Service
In the course of negotiations, the parties have agreed to begin participation in the
retirement benefit propm offered though the Wisconsin Retirement Service (hereinafter "WRS
Pension Plan") effective on January 1, 1997. This participation in the WRS Pension Plan is for
future service credit only. Participation in the WRS Pension Plan shall be as pursuant to the rules
established by the Wisconsin Retirement Service.
The current City of Muskego Pension Plan & Trust (the "Plan") will be frozen as of
December 31, 1996, and no additional benefit accruals will be made under the Plan after
December 31, 1996. Contributions as negotiated through the period ending on December j 1,
1996 shall be contributed to the Plan. 0 The Trustees of the Plan shall continue to have dl rights and obiigations, as they have had
in the pa to administer the Plan. No benefit to which a Plan participant has earned a
nonforfeitable right under the terms of the Plan may be reduced or eliminated in the future. If
any issues arise concerning the Plan that require negotiation with the Muskego Area Public
Employees Union, Local 2414, the City shall satisfy all legal obligations attendant thereto.
As soon as reasonably and administratively practicable after January 1, 1997, the Trustees
will take steps to terminate the City of Muskego Pension Plan & Trust. All employees who are
Plan participants as of December 31, 1996 will become 100% vested as of December 31, 1996.
Once the Plan has been terminated, distributions to Plan participants will be made in accordance
with applicable law. Distribution information will be provided to Plan participants, including
information about forms of distribution, tax withholding, and rollover options.

RE: Group Term Life Insurance Benefits
In the course of negotiations, the parties have agreed to begin participation in he group
term lif? insurance program offered through the Wisconsin Retirement Service (herehaftr "WRS
Life Plan"), effective January 1, 1997. Participation in the WRS Life Plan shall bt 25 pursuant
to the rules established by the Wisconsin Retirement Service and as outlined below.
During the initial six month waiting period beginning on January 1, 1997, the City shall
maintain the current life insurance program so that there is no gap in coverage.
FTE Premiums. The City will pay one hundred percent (100%) of the prtslium cost for
the standard LVRS Life Plan benefits for 111 time employees. Full time employees may also
purchase supplemental coverage under the WRS Life Plan, if eligible, at their own expense,
through authorized payroll deductions.

PTE Premiums. For eligible part time employees who exercise their option io participate
in the WRS Life Plan, the City will pay a prorated portion of the premium cost for &e standard
WRS Lift Plan benefit, based on the percentage of full time hours that the part time employe:
is regduly scheduled to work. In no event shall the City's contribution for a part time
employee's LVRS Life Plan standard benefit be less than twenty percent (20%) of the premium
cost.
