CCR1996202e Resolution Reconsidered, Amended h Adopted 9/24/96 AMENDED COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #202-96 DETERMINATION OF SUBSTANTIAL CHANGE TO ORIGINAL MEADOW GREEN WEST OPD (Wetland Delineation) WHEREAS, the wetland delineation originally illustrated on the final recorded plat for Meadow Green West OPD for Lots 98 through 108 is proposed to be amended by Boehm Construction: and WHEREAS, it has since been determined independently and by the Army Corps of Engineers and Department of Natural Resources that wetlands due to changes in the hydrology and vegetative character portions of the subject properties are no longer considered to be of the the parcels in question; and WHEREAS, the Plan Commission recommends approval of the proposed amended wetland delineation as follows: 1. The specific alterations to the wetland delineation on Lots 98, 100 and 102 will be decreased by 30 feet and the Plan Commission views this as a nonsubstantial change and does not recommend that a public hearing be held for the 30' change. 2. The overall alterations to the wetland delineation on Lots 98 through 108, and Lots 118, 119, 120, and 121 does constitute a substantial change and does recommend that a public hearing be held before the Common Council. NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego, upon the recommendation of the Plan Commission, does hereby find that the specific alterations to the wetland delineation on Lots 98, 100 and 102 are nonsubstantial and thus not require a public hearing, subject to receipt of approval from the DNR. BE IT FURTHER RESOLVED that the Common Council of the City of Muskego, upon the recommendation of the Plan Commission does recommend that the proposed overall alterations to the wetland delineations on Lots 98 through 108, and Lots 118, 119, 120, and Unit Development and does hereby direct Boehm Construction to 121 does constitute a substantial change to the original Planned petition for a public hearing to be held before the Common Council of the City of Muskego.
