CCR1996023COMMON COUNCIL - CITY OF MUSKEGO RESOLUTION #23-96 APPROVAL OF CERTIFIED SURVEY MAP Kaebisch WHEREAS, a Certified Survey Map was submitted on December I, 1995 to finalize a one-parcel division of the Kaebisch property on Racine Avenue in the NW 1/4 of Section 29; and WHEREAS, the Plan Commission has recommended approval subject to the conditions outlined in Resolution #P.C. 192-95, as amended. NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego, upon the recommendation of the Plan Commission, does hereby approve the Certified Survey Map to finalize a one-parcel division of the Kaebisch property on Racine Avenue in the NW 1/4 of Section 29 subject to the conditions outlined in Resolution #P.C. 192-95, as amended. BE IT FURTHER RESOLVED that this approval is subject to receipt of all fees required by Section 18.14 of the Land Division Ordinance, any special assessments which may be due, and approval 0 of the City Engineer. Resolution #23-96 which was adopted by the Common Council of the 1/96 jmb e FORM NO. 905j - YFM" Stock No. 26273 J I AMENDED APPROVAL OF CERTIFIED SURVEY MAP CREATING ONE PARCEL OF THE PROPERTY LOCATED IN THE NW 1/4 OF SECTION 29 (PARKER DRIVE & RACINE AVENUE) RESOLUTION #P.C. 192-95 1995, to create a one (1) lot land division located in the NW 1/4 of Section 29, and WHEREAS, A Certified Survey Map was submitted on December I, October 3, 1995, that substantially conforms to the Certified Survey Map submitted on December I, 1995, and WHEREAS, A sketch was approved by the Plan Commission on WHEREAS, The property is zoned Exclusive Agriculture (EA) which permits pre-existing residences provided any parcels to be created conform to the R-3 Country Home District, and sq.ft. and 150' average width and the subject parcel to be created appears to meet these restrictions, and WHEREAS, The R-3 District requires lots totaling 40,000 WHEREAS, The EA district allows for new parcels to be created at the R-3 standard if the residence or structure existed prior to the adoption of the ordinance, and e was constructed in 1995 while the ordinance was adopted in 1963, and WHEREAS, The residence for which this division is intended WHEREAS, Such zoning would be compatible with other similar divisions and surrounding land uses. THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval of the Certified Survey Map creating a one (1) lot land division of the property located in the NW 1/4 of Section 29 subject to: 1. The lot being created having no less than 1.8 acres. 2. The resolution of all technical discrepancies and conditions as identified by the City Engineer, City Staff and the Plan Commission.
