APPROVAL OF THREE-PARTY STATE/MUNICIPAL AGREEMENT
FOR A HIGHWAY IMPROVEMENT PROJECT
(Moorland Road Extension)
BE IT RESOLVED that the Common Council, upon the recommendation
of the Public Works Committee, approves the attached Three-Party
State/Municipal Agreement for a Highway Improvement Project for
the Moorland Road Extension.
BE IT FURTHER RESOLVED that the Mayor is authorized to execute
the Agreement in the name of the City subject to review by the
City Engineers.

Whereas, two units of local government in the State of Wisconsin, referred to hereinafter as the
Municipalities, including the signatory Waukesha County, hereinafter called Waukesha, and the
signatory City of Muskego, hereinafter called Muskego, through their duly authorized officers and
officials, have requested the State of Wisconsin Department of Transportation, hereinafter called the
State, to initiate 2nd efect certain highway or street improvements hereinafter referred to as the
Project and described below, and,
Whereos, the authoq for the Municipalities to enter into this agreement with the State is provided by
Section 86.25( I). (2) md (3) ofthe Statutes,
Now Therefore, the Municipalities and the State agree to the concept, scope and cost estimates
contained herein as detailed below.
NEEDS AND ESTIMATE SUMMARY.
Existing Facility - Describe and give reason for request:
The existing roadway system does not provide for adequate north-south access between 1-43
and the Crty of Muskego. This means that residents must use Racine Ave. (CTH Y) or
Janesville Road (CTH L) to gain access to the freeway system. This lack of access has
hindered development in the area. The project is recommended in Regional Transportation
Plan published by the Southeastern Wisconsin Regional Planning Commission.
Proposed Improvement - Nature of work
Extension of Moorland Road (CTH 0) south from 0.8 km N of College Avenue (CTH HH)
to Janesville Road (CTH L). (The section of roadway needed to make this project contiguous
with the arterial street & highway system--from 1-43 to 0.8 km N of CTH H--will be
construcied by the Crty of New Berlin at local expense and is not a part of this Agreement).

The apportionment of costs for work necessary to finish the project (including non-participating work
and work which will be undertaken by the municipalities) is as follows:

* Engineering design services and real estate acquisition shall be accomplished at 100% local
expense in a proportion to be determined by mutual agreement between Waukesha County,
the City of Muskego and the City of New Berlin and are NOT a part of this Agreement.

This request is subject to the terms and conditions that follow (pages 3 through 5) and is made by the
under;igned under proper authority to make such request for the designated Municipalities and the
State and upon acceptance by the State shall constitute agreement between the Municipalities and the
State.

Waukesha shall act as Lead Agency for the project and shall be responsible to the State for
paying the Municipalities' local share of all project costs over to the State. Muskego and
Waukesha may, at their option and discretion, sign a separate agreement for the
apportionment of local costs of the Project, but such agreement shall not in any way relieve
Waukesha of the obligation to transfer all appropriate local share amounts to the State.
The State shall deduct the entire Federal share of project costs from Muskego"s "balance" in
the Surface Transportation Program--Urban for the Milwaukee Urbanized Area.
The initiation and accomplishment of the improvement will be subject to the applicable
Federal and State regulations.
The Municipalities will pay to the State all costs incurred by the State in connection with the
improvement which exceed Federalfitate financing commitments or are ineligible for
Federalfitate financing.
Funding of each project phase (preliminary engineering, real estate, construction, and other) is
subject to inclusion in an approved program. Federal aid and/or State transportation fund
financing will be limited to participation in the costs of the following items as specified in the
estimate summary:
a. The grading, base, pavement, and curb and gutter
b. Catch basins and inlets for surface water drainage of the improvement, with connections
to the storm sewer main.
c. Construction engineering incidental to inspection and supervision of actual construction
work.
d. Signing and pavement marking, including detour routes.
e. Storm sewer mains necessary for the surface water drainage
f. Construction or replacement of sidewalks and surfacing of private driveways.
g. New installations or alteration of street lighting meeting State standards and trafk signals
or devices if warranted.
Work necessary to complete the improvement to be financed entirely by the Municipalities or
other lrtility or facility owner includes the following items:

a. Preliminary engineering and state review services.
b. Real estate for the improvement.
c. All construction and construction engineering expenses for work north of College Avenue
(CTH HH).
d. New installations of or alteration of sanitary sewers and connections, water, gas, electric,
telephone, telegraph, fire or police alarm facilities, parking meters, and similar utilities.
e Damages to abutting properly due to change in street or sidewalk widths, grades or
drainage.
f. Conditioning, if required, and maintenance of detour routes
g. Repair of damages to roads or streets caused by reason of their use in hauling materials
incidental to the improvement.
h. Bridge width in excess of standards.
7 & the work progresses, Waukesha will be billed for work completed which is not chargeable
to Federalbtate funds. Upon completion of the project, a final audit will be made to
determine the final division of costs.
8. If the either Muskego or Waukesha should withdraw from the project, that municipality will
reimburse the State for any costs incurred by the State on behalf of the project.
9. The work will be administered by the State and may include items not eligible for
FederalBtate participation.
IO. Muskego and Waukesha will at their own cost and expense:
a. Maintain all portions of the project that lie within their respective jurisdictions for such
maintenance through statutory requirements. in a manner satisfactory to the State and will
make ample provision for such maintenance each year
b. Prohibit angle parking
c. Regulate or prohibit all parking at locations where and when the pavement area usually
occupied by parked vehicles will be needed to carry active traffic in the street.
d. Regulate and prohibit parking at all times in the vicinity of the proposed improvements
during their construction.

e. Assume general responsibility for all public information and public relations for the project
and to make fitting announcements to the press and such outlets as would generally alert
the affected property owners and the community of the nature, extent, and timing of the
project and arrangements for handling traffic within and around the project.
f. Use the WisDOT Utility Accommodation Policy unless they adopt a policy which has
equal or more restrictive controls.
