CCR1995158OF MUSKEGO RESOLUTION #158-95 APPROVAL OF AGREEMENT TO PAY FOR MUNICIPAL SERVICES BETWEEN THE CITY OF MUSKEGO AND NATIONAL REGENCY OF NEW BERLIN, INC. WHEREAS, National Regency of New Berlin, Inc., referred to in amend the zoning map of the City of Muskego for a proposed senior said Agreement as Muskego Regency, has petitioned the City to citizens housing development; and WHEREAS, the City of Muskego and Muskego Regency are both desirous of entering into an Agreement to pay for the municipal services associated with said development. NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego does hereby approve the attached Agreement, as Muskego and National Regency of New Berlin, Inc. amended, to Pay for Municipal Services Between the City of BE IT FURTHER RESOLVED that the Mayor and Clerk are authorized to execute said Agreement in the name of the City. Resolution #158-95 which was adopted by the Common Council of the 8/95 jmb Agreement to Pay for Municipal Services THIS AGREEMENT, made this day of , 1995, by and between NATIONAL REGENCY OF NEW BERLIN, INC.. a Wisconsin Comoration. hereinafter referred to as “Muskego Regency”, and the CITY OF MUSKEGO, a Wisconsin Municipal Corporation, hereinafter referred to as “CITY ” WHEREAS, MUSKEGO REGENCY is a non-profit organization desiring to operate a Geriatric Center in the CITY; and WHEREAS, the MUSKEGO REGENCY shall acquire 32 acres of real estate located on the northeast corner of Racine Avenue and Woods Road; WHEREAS, MUSKEGO REGENCY is a civic-minded organization and is desirous of paying its fair share for municipal services; and WHEREAS, the CITY is desirous of establishing an amount with which MUSKEGO REGENCY shall pay for municipal services. NOW, THEREFORE, in consideration of the covenants contained herein, the parties hereto agree as follows: 1. In the event MUSKEGO REGENCY acquires said real estate and as long as said entity is entitled to be exempt from general property taxes, MUSKEGO REGENCY will pay that property’s share of the cost of municipal services. 2. The amount of said payment shall be paid each year when general property taxes would be due and payable and the amount shall be determined as follows: One half of the assessed value of the structures and land, multiplied by the City of Muskego tax rate. For example, in 1994 such amount was 4.66 per thousand dollars of assessed value. The rate per thousand shall be exclusive of the Waukesha County Tax, State of Wisconsin Tax, WCTC, and Muskego-Norway School Tax. 3. The payment referred to above for municipal services is in addition to any and all other payments due the municipality by tax-exempt organizations included, but not limited to, sewer user fees, water user fees, fees for garbage collection, special assessments, special charges, ambulance and/or fire charges, etc. Agreemenl to Pay for Municipal Senices Page 2. a Dated this day of h~,- , 1995.
