APPROVAL OF FINAL PLAT,
RESOLUTION #113-95
SUBDIVIDER'S AGREEMENT AND LETTER OF CREDIT
CHAMPIONS VILLAGES OF COUNTRY CLUB VILLAGES
WHEREAS, a Final Plat was submitted on April 21, 1993 for the
in the NW and NE 1/4 of Section 25; and
190-lot Champions Villages of Country Club Villages Subdivision
WHEREAS, the Preliminary Plat was approved in Resolution
#119-93; and
WHEREAS, the Plan Commission has recommended approval; and
WHEREAS, the Subdivider's Agreement and Letter of Credit have
been received for Champions Villages of Country Club Villages,
as attached, and the Finance Committee has recommended approval.
NOW, THEREFORE, BE IT RESOLVED that the Common Council Of the
City of Muskego, upon the recommendation of the Plan Commission,
does hereby approve the Final Plat for the 190-lot Champions
Villages of Country Club Villages Subdivision in the NW and NE
1/4 of Section 25, subject to approval of the City Engineer and
all objecting and approving agencies, and receipt of all fees as
provided in Section 18.14 of the Land Division Ordinance.
BE IT FURTHER RESOLVED that the Subdivider's Agreement and
Letter of Credit for Champions Villages of Country Club
Villages, as amended and attached, is hereby approved subject to
approval of the City Attorney and City Engineer, all of said
approvals to be obtained within thirty (30) days of the date of
approval of this Resolution or the same will be null and void.
BE IT FURTHER RESOLVED that approval of this Resolution is
subject to passage of Ordinance #869-95.
BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby
authorized to sign the necessary documents in the name of the
City.

We hereby issue this irrevocable documentary credit in your favor which is available by beneficiary's drafts at
sight drawn on Associated Bank. Each dralt accompanying documenrs must state "Drawn Under Associated
Documentary Credit No.
This Standby Credit is to provide a guaranty to the City of Muskego for the perf0rmanc.e of The Villages at
Muskego Lakes Partnership obligations under that certain Agreement dated -
between the City of Muskego and applicant.
DRAFTS .4RE TO RE ACCOMPANIED BY:
A statement signed by the Mayor of the City of Muskego stating chat The Villages at Muskego Lakes Partnership
has failcd to complete rhe construction of subdivision improvements in accordance with said Agrcernent. Said
statement shall set forth the estimated amount necessary for the C.ity of Muskego to complete such
improvements.
SPECIAL COXDII'IONS:
This Standby Credit will terminate on , or 90 days provided, howevcr. the
Associated Bank shall give written notice to the beneficiary of its intention to terminate this Standby Credit at
least 90 days prior to -. Mer the date stated in this paragraph, this Letter of Credit
can only terminate upon 90 days written notice to the bencficiary.
If any improvement is not completed and the beneficiary receives a notice of termination pursuant to this Letter
of Credit prior to completion of all ofthe improvements, said notice shall be considered a failure to colnplete the @improvements in accurdance with the Agreement and shall entitle the beneficiary to immediately draw against this
Lettcr of Credit.
