APPROVAL OF HOLDING TANK AGREEMENT

WHEREAS, the City of Muskego has received a request from
Helen Smith the present owner, and a future buyer for the
property, for permission to install a holding tank to serve
property at W216 S10621 Crowbar Road in the City of Muskego; and
WHEREAS, it is required by the Department of Industry, Labor and
Human Relations that the City guarantee maintenance of the
Holding Tank; and
WHEREAS, an Agreement for Permission for a Temporary Waste Water
Collection System and Holding Tank has been, or will be,
submitted by the applicants.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego does hereby approve the installation of a holding
tank to serve the property located at W216 S10621 Crowbar Road in
the City of Muskego subject to a performance bond being posted in
an amount determined by the Building Director for future work
that needs to be completed prior to the execution of the
Agreement by the City.
BE IT FURTHER RESOLVED that the Mayor and City Clerk are
authorized to execute the holding tank agreement in the name of

the City.
BE IT FURTHER RESOLVED that as this property is to be sold
shortly, both the present owner and future buyer shall execute
said Agreement.
