DISALLOWANCE OF CLAIM ON EXCESSIVE ASSESSMENT
BY MARY THOMAS PURSUANT TO
SECTION 74.37, WISCONSIN STATUTES
WHEREAS, the City of Muskego has received a claim from Mary
Thomas on excessive assessment; and
WHEREAS, the claim purports to be in accord with the appeal
procedures per the Wisconsin Statutes; and
WHEREAS, 574.37, Wisconsin Statutes, states the basis for a
claim under this section; and
WHEREAS, Mary Thomas filed a claim on excessive assessment for
1994; and
WHEREAS, it appears that pursuant to 574.37(2)(b), Wisconsin
Statutes, the claim is defective in that it does not properly
accurately as possible the amount of the claim; and
state the circumstances giving rise to the claim and state as
WHEREAS, it further appears that in any event, the claim does
not state a proper basis for the claim pursuant to
574.33(l)(a) to (e), Wisconsin Statutes, as is the position of
the City Assessor pursuant to the attached memo dated November
1, 1994.
NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the
574.37(3), Wisconsin Statutes, the claim filed by Mary Thomas
concerning property known as Tax Key No. MSKC 2180.994 on
excessive assessment.
BE IT FURTHER RESOLVED that notice of this disallowance shall
be sent to the claimant by certified mail forthwith.

I will attempt to address each concern of Mary Thomas in regards to her 1994
assessment for the property located at Racine, Tans, and Hillendale. The
current assessmenc for the approximately 16 acres of land is $162,900.
1. Comparable commercial sales are limited for this community. They range
in value for raw land to $12,000 per acre for mixed development to upwards
of $116,000 per acre for semi-improved. Ms. Thomas is compari3g her
property to residentially zoned property. This property is currently zoned
E-2 or commercial. Properties located to the north of this property are
valued at approximately $38,100 per acre and commercial properties located
on Janesville Road are valued at $36,600 per acre. The northern properties
are smaller tracts (2.565 acres) while those located on Janesville Road are
larger tracts (19 acres).

3. The two properties used in this comparison are zoned residential. Tax
key ;2179.993 recently became Lakeview Highlands North. Tax key #2179.?98
is currently under review 2s there are no sewers available to this prooerty
bur: it is directly adjoining Lakeview Sighlands North.
4. Installation of sewers make this property more valuable, not less
desirable.
5. Not an assessment question
considered agricultural, a minimum of 35 acres is required with its sole and

best use as farming.
7. Land has been reclaimed and is buildable.
8. The 5 acre green space enhances property and is desirable from a City
Planning viewpoint.
9. Ms. Thomas was questioned at to what price she is currently listing her
property and what offers has she turned clown. She would not commit x0 any
numbers and as she states on her letter, she would sell the property for
more than what it is currently assessed. I have to assess at current fair
market value and the number used now is not speculative.

The value breakdown for :his property is 435,600 square feet at $0.70 per
square foot at 50% recognizing its restrictive use , the balance of 298,740
square feet at $0.07 per square foot at 50%, for a total of $162,900. All
commercial land is valuei at a square foot price in this community.
