RE-APPROVAL OF LEGAL LOT STATUS

WHEREAS, legal lot Status of Lot 35 of Mill Valley Unrecorded
as requested by Paul De Angelis, Sr. was approved in Resolution
#132-93, with certain conditions, and
WHEREAS, the conditions included obtaining approval from the
Wisconsin Department of Natural Resources and the rezoning of
the driveway off of Gold Drive out of the Floodplain by the
Common Council, and
WHEREAS, the DNR has no objections to the proposal, and
WHEREAS, it has been determined by the Director of Planning,
based on DNR and City Ordinance review, that rezoning subject
driveway off Gold Drive out of the floodplain is not required at
this time.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego, does hereby re-approve the legal lot status of
lot 35 of Mill Valley Unrecorded, subject to all the conditions
of approval of Resolution #132-93, except that the condition to
rezone the driveway off Gold Drive out of the Floodplain is no
longer required at this time, and that subject driveway shall be
constructed one foot above the 100-year flood elevation, that
two 15 inch diameter CMP culverts shall be installed beneath
applied for prior to the commencement of filling activities. subject driveway, and that all applicable fill permits be
