RESOLUTION #166-93
RESOLUTION TO RETAIN SPECIAL COUNSEL TO REPRESENT THE
OUT OF THE CONSTRUCTION OF THE LAKE FOREST DEVELOPMENT
CITY OF MUSKEG0 IN REGARDS TO ANY LITIGATION ARISING
WHEREAS, it is likely that the Little Muskego Lake Association
will commence litigation under the clean Water Act against
Terra Development over the Lake Forest Development and/or other
matters arising concerning the construction of Lake Forest
Development, and
WHEREAS, it appears that the City of Muskego may be involved in
this litigation and it appears the position of the City of
Muskego may be adversarial to the position of Terra
Development; and
WHEREAS, the Mayor and Aldermen are aware that the sister of
City of Attorney Don Molter’s wife is married to William
Carity, one of the primary representatives of Terra
Development; and
WHEREAS, the City being represented by the City Attorney in
such litigation may give the appearance of impropriety to the
general public as to positions taken by the City Attorney, the
City Attorney‘s law firm and the City of Muskego.
NOW, THEREFORE, BE IT RESOLVED that the City of Muskego will
retain special counsel to represent the City of Muskego in
regards to any litigation and related matters arising out of
the construction of Lake Forest Development and in order to
avoid the appearance to the general public of any impropriety
Muskego.

BE IT FURTHER RESOLVED, that the City of Muskego hereby retains
the law firm of Frebert, Finnerty & St. John, S.C. as special
counsel concerning these matters.
