Modification of Deed Restrictions - Stefaniak
WHEREAS, at the time of sewer installation on Muskego Drive in
the Oak Ridge Unrecorded Subdivision, the owners of the parcel
identified as the South 1/2 of Lot 16, Lot 17, Lot 18 and Lot 19
agreed to a land covenant which restricted the property to one
residence, and had one sewer lateral installed; and
WHEREAS, a residence was constructed on the South 1/2 of Lot 16
and Lot 17 and a second residence is being constructed on Lot 18
and Lot 19; and
WHEREAS, the owners have requested that the land covenant
restricting the property to one residence be removed; and
WHEREAS, because of the land covenant, a reduced sewer
assessment was negotiated; and
WHEREAS, the Public Utilities Committee has recommended a
theoretical front foot sewer assessment of $2,697.50 (62.5 ft. x
$43.16) be paid prior to the land covenant restricting the
property to one residence being removed in consideration for
said removal of the same plus payment of City Attorney's fees
regarding the same; and
WHEREAS, the Finance Committee has recommended removal of the
land covenant subject to payments stated above.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego, upon the recommendation of the Public Utilities
Committee and the Finance Committee, does hereby authorize the
Mayor and Clerk to sign the necessary recordable documents to
remove the land covenant, subject to payment of $2,697.50 plus
attorney fees, signatures on the document of all the owners of
the property involved agreeing to removing the land covenant.
