DISAPPROVAL OF OFFER TO PURCHASE
City-Owned Property on Ruby Drive
WHEREAS, two Offers to Purchase the City-owned property
described as Lot 62, Block 20, Jewel Crest Subdivison, located
on Ruby Drive were received; and
WHEREAS, one offer was submitted by Thomas Harr in the amount of
the amount of $8,000.00; and
$7,000.00 and one offer was submitted by Alan & Suzanne Arndt in
WHEREAS, the Finance Committee reviewed both offers and
recommends a Counter-Offer be made to the Arndt's.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego, upon the recommendation of the Finance
Committee, does hereby disapprove the attached Offer-to-Purchase

BE IT FURTHER RESOLVED that the City Attorney is hereby directed
to prepare a Counter-Offer to the Arndt's to include information

that the transaction will be null and void unless buyers are
successful with the purchase of Lot 61, Jewel Crest Subdivision.
BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby
authorized to sign said Counter-Offer.

This addendum is a part of the Offer to Purchase dated
the vacant lot on Ruby Drive in the City of Muskego, identified as
Lot 62, Block 20, Jewel Crest.
1. PURCHASE OF LOT 61. BLOCK 20, JEWEL CREST: This offer is
contingent upon the purchase and successful closing of Lot 61,
Block 20, Jewel Crest, City of Muskego, Waukesha County, Wisconsin,
on or before September 30, 1992. In the event Buyers are unable to
enter into a purchase contract, obtain required approvals, and/or
close on Lot 61, Block 20, Jewel Crest, within the time specified
above, this offer shall become null and void and Seller shall
return all earnest money to the Buyers.
2. APPROVALS: This offer is contingent upon the Buyers, at
government agencies, including but not limited to the Wisconsin
their expense, obtaining the approvals required from all concerned
Department of Natural Resources, indicating that the subject lot is
buildable and that Buyers have approval to construct a single-
family residence and garage on either Lot 61 and/or Lot 62, Block
20, Jewel Crest, at any time subsequent to Buyers receipt of such
approvals. In the event Buyers are unable to obtain such approvals
by August 31, 1992, Buyers, at their option, may declare this offer
null and void and Seller shall return all earnest money to the
Buyers.
0. ZONING VARIANCE: This offer is contingent upon Buyers, at
variance from the front setback restriction of 40' to 25' feet on
their expense, obtaining approval from the City of Muskego for a

the event Buyers are unable to obtain such approval by August 31,
