RESOLUTION INDICATING CITY'S PRESENT INTENT
TO APPROVE THE CONCEPT OF RS-Z/OPD ZONING
Kaerek Builders -- Denoon Point Estates
WHEREAS, Kaerek Builders has petitioned the Council to rezone
property located in the NW 1/4 of Section 31 from RS-2 to
RS-2/0PD to allow for 105 single-family residential lots; and
WHEREAS, the necessary public hearing has been held; and
WHEREAS, the City wishes to indicate its present intention of
approving the concepts which so far have been presented by
Kaerek Builders and wishes to defer acting on the rezoning until
all requirements of the City's ordinances pertaining to planned
unit developments have been met.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego does hereby indicate its present intention that
Builders and defers acting on the rezoning request until all
it approves of the concept of the project proposed by Kaerek
developments have been met.
BE IT FURTHER RESOLVED that this deferral is with the agreement
of the petitioner.
BE IT FURTHER RESOLVED that an approximate 2-acre siltation pond
shall be located on City property with the cost to be the
responsibility of the developer and be constructed 7-8' deep to
support fish life.
