AMENDED
RESOLUTION AS TO COUNTER-OFFER TO PURCHASE
(City-Owned Land - Fountainwood Addn. #2)
BE IT RESOLVED that the Common Council of the City of Muskego,
upon the recommendation of the Finance Committee, does hereby
reject the attached Counter-Offer to Purchase for Lot 12, Blk 15
Fountainwood Subdivision from Anthony and Lisa Migliaccio, as
attached, and does hereby authorize the Mayor to contact the
prospective purchasers to advise them that the City's original
Counter Offer still stands.
BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby
authorized to sign the necessary documents in the name of the
City.

1. The purchase price stated at Line 11 shall be Twenty-Five
Hundred Dollars ($2,500).
2. The place of closing at Line 65 shall be changed to
Muskego City Hall, W182 S8200 Racine Avenue, Muskego, Wisconsin.
3. Lines 80 through 92 are deleted and replaced as follows:
"That this property is being sold 'as is' and the Seller
makes no warranties or representations as t3 the condition of the
property in any respect including, but not limited to, whether or
buildability, any applicable shoreland or special use regulations
not it is in a flood plain, whether or not it is in a wetland, its
or the presence or lack thereof of any dangerous or toxic
materials or conditions affecting the property. The Buyers
warrant and represent that they have had the opportunity to
inspect the property and that the Buyers are relying exclusively
on their inspection in proceeding with this purchase and not on
any warranties or representations of the Seller."
