RESOLUTION #39-89
PETITION TO REZONE
(Kurer - RS-2 to RS-2(0OS)
WHEREAS, the Common Council of the City of Muskego is petitioning
reconstruction project located at Schultz Lane and Durham Drive
to rezone the Kurer property adjacent to the City's Schultz Lane
from RS-2 to RS-2(00S) on behalf of Lynn Kurer, and
WHEREAS, the Finance Commitee has recommended the $75.00 fee be
waived except that if the rezoning is not approved by the Common
Council the $75.00 fee will be the responsibility of Lynn Kurer.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego, upon the recommendation of the Finance
Committee, does hereby petition to rezone the Kurer property
adjacent to the City's Schultz Lane reconstruction project
located at Schultz Lane and Durham Drive from RS-2 to RS-2(00S)
on behalf of Lynn Kurer, subject to review and approval of Atty.
Molter.
BE IT FURTHER RESOLVED that the $75.00 fee be waived except that
fee will be the responsibility of Lynn Kurer.

Pursuant to our conference of February 17, 1989, I could approve of
Resolution 839-89 if the following action was taken:
1. There is no relation between the Schultz Lane project and the
rezoning: and
2. As, in fact, the City is applying for the rezoning, in no event
will Lynn Kurer be responsible for the $75 filing fee.

On Friday, February 24, 1989, Lynn Kurer presented the City with
a $75.00 check for the rezoning of the property located at
