APPROVAL OF CONCEPT OF AMENDING
DEFERRED SEWER ASSESSMENT POLICY '1
WHEREAS, the City of Muskego may wish to amend its Deferred Sewer
Assessment Policy to provide for a special policy when agricultural
land is acquired for sewer purposes and when contributions in aid of
construction are available for at least a portion of the cost of said
sanitary sewer improvements.
NOW, THEREFORE, BE IT RESOLVED that the City of Muskego approves of
the concept of amending its Deferred Sewer Assessment Policy to allow
for the deferral of a special sewer assessment as to agricultural land
when portions of said land are being acquired for sewer purposes and
when contributions in aid of construction are available for at least a
portion of the cost of said sewer improvement and a special deferral
would be for a period of ten years with no interest; that this
Resolution is only an approval of such a concept and is not an
amendment to the Deferred Sewer Assessment Policy, but is merely an
indication by the Common Council of its present intent to make such a
change in policy, if and when the details of such a change can be
worked out.
BE IT FURTHER RESOLVED, that the potential first use of the above
mentioned new concept would involve acquisition of sewer easements
whereby the property owner wishes for the following to be part of the
final agreement which is proposed to include in part:

Topsoil is all removed and replaced over sewer at a depth for
agricultural purposes.
Gravel backfill (where road anticipated).
Amount of excess fill from sewer placed where property owner
designates by contractor. Topsoil on area filled removed before
filled and placed over fill after project completed.
Property owner will get an agreement that all fill from sewer
project outside of his land will be placed in fill area provided
by property owner.
Sewer assessment established by agreement and deferred for ten
years with no interest, with assessment becoming due and payable
upon development with proration at 125% of front foot assessment
sewer deferment policy in effect at that time. Only footage that if partial development occurs, or extended at ten years at the
will be used for development of the parcel will be assessed
starting at Industrial Park property line and extending westerly
on proposed road right of way.

6. City will be responsible for rehooking all tile lines cut by sewer
project.
7. The sewer project will be completed by March 1, 1989 and any crop
damage will be the responsibility of the City, if work on sewers
is done later.
8. The permanent easement which is not assessable and being used for
road purposes shall be forty (40) ft., lus twenty (20) ft. temporary construction easements on eacg side.
BE IT FURTHER RESOLVED that the City of Muskego is not hereby
approving of the above but is indicating it approves the present
intention as to approval of such a concept and working toward a final
agreement.
