WHEREAS, a certified survey map was submitted on 9/15/88 to
finalize a division of the Ingersoll/Giefer property in the NE
114 of Section 9, and
WHEREAS, the Plan Commission has recommended approval.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego, upon the recommendation of the Plan Commission,
does hereby approve the certified survey map to finalize a
division of the Ingersoll/Giefer property in the NE 114 of
Section 9.
BE IT FURTHER RESOLVED that this approval is subject to receipt
of all fees required by Section 10 of the Land Division Ordinance
and approval of the City Engineer.
BE IT FURTHER RESOLVED that the attached Plat of Perpetual Water

and the City of Muskego, a Municipal Corporation located in Waukesha
County, Wisconsin, hereinafter referred to as a second party,

It is an express condition of the granting of this perpetual water
main easement and temporary construction easement that so much of the
surface and sub-surface of the soil as may be disturbed in the construction,
operation, use, maintenance and repair ( including reconstruction ) of
such water main will, at the expense of second party, be replaced in
substantially the same condltion as it now is or may be, and the acceptance
@of these easements by second party and the installation or construction
of such water main shall constitute an express accep
of this condition to the granting of these easements

First parties consent to the entry by the servants, employees, workmen,
agents or independent contractors of second party for and incidental to
the construction, operation, use. maintenance. and repair ( including
reconstruction ) of such water main. but reserve to themselves the right
to make use of the land included in said easement, subject to the
ordinances of the City of Muskego and the Statutes of the State of
Wisconsin, as will not disturb or interfere with such water main or
prevent ingress and egress thereto for the purpose of construction,
operation, use, maintenance and repair ( including reconstruction )
thereof.

This indenture, upon its acceptance by second party, shall be
1 binding upon and inure to the benefit of the parties hereto, their
respective heirs, successors and assigns.
