RESOLUTION #223-87
INSTALLATION OF WATER IMPROVEMENTS AND LEVYING SPECIAL
AMENDMENT TO FINAL RESOLUTION-145-87 AUTHORIZING
ASSESSMENTS AGAINST BENEFITTED PROPERTY AND
WAIVER OF SPECIAL ASSESSMENT NOTICES AND HEARINGS
UNDER §66.60( 18)
(Water Main Assessment Area MW-3-87)
WHEREAS, on the 31st day of March, 1987, the Common Council
of the City of Muskego adopted Resolution #45-87; and
known as Parkmaster Attractions, Tax Key Number 2193.970, legal
description attached, and
WHEREAS, one of the properties assessed was the property
WHEREAS, the property status was changed from residential to
commercial on May 21, 1987, and
WHEREAS, said property may no longer be classified as
"controlled access", and
WHEREAS, it is necessary to amend said assessment to the
following:
1,372 ft. Commercial Assessment @ $16.00/ft. - $21,952.00
2" Water Service - 1,039.05

NOW, THEREFORE, BE IT RESOLVED for valuable consideration
acknowledged by both parties as follows:
1. That the charges described above, shall be assessed
against said property and the assessment roll shall be
amended accordingly.
2. That by executing the acceptance of this resolution as
stated below, the owners of said property also hereby
waive special assessments and notices and hearings
under §66.60(18) and consent to the levying of special
assessments against their property for the costs of
said improvement under Wisconsin Statute §66.60 and
further agrees and admit that the benefit to the
property in question from the construction of said
improvement is just and reasonable.
3. All provisions of Resolution #45-87 and all documents
referred to therein, unless specifically amended by
this resolution, remain in full force and effect, and
contract by all owners of the property in question by
if this resolution is not accepted as a binding
October, 1987, time being of the essence, this
executing this document on or before the 30th day of
resolution shall be null and void.
