PETITION TO AMEND Z2XING TEXT AVD REZONE PROPERTY TO
TRANSITIONAL AGRICULTURE ZONING
BE IT RESOLVED that the Common Council of the City of Muskego,
upon its own motion, does heriby petition to create
"Transitional Agriculture" zoning.
BE IT FURTHER RESOLVED that the Common Council has determined
that the change is of such comprehensive nature that individual
mailed notice is zot necessary in accordance with 17:3.07 of
the Municipal Code.
BE IT FUR::HER RESOLVED that the Council does hereby refer this
matter to the Plan Commission €or review and recommendation,
and sets the public hearing date for October 27, 1987.

I, Jean Narenda, Deputy City Clerk of the City of Muskego, do
hereby certify that on September 25, 1987, Mayor Wayne G.
Salentine of the City of Eluskego, stated to this office his
intention to veto Resolutioz F196-87, Petition to Amend Zoning
Text and Rezone Property to Transitional Agriculture Zoning,
which was adopted by a vote of 4 "yes" and 2 "no" at the Common
Council meeting held Septenser 22, 1987.

VETO MESSAGE
Amend Zoning Text and Rezone Property to Transitional Agriculture
I have made the decision to veto Resolution #196-87, Petition to
Common Council meeting held September 22, 1987, after conferring
Zoning, which was adopted by a vote of 4 "yes" and 2 "no" at the
with City Attorney Molter and Dave Fodroczi, Farmland
Preservation Office.
It was determined that assessments could not be levied against
Transitional Agriculture Zoning. The City does have the
prerogatve to rezone property at the City's discretion but then
the City becomes liable for credits that the property is liable
for over a ten year period, subjecting the Utility to not have
the ability to assess for improvements and a potential for
credits that a propety has received is not in the best interest
of the Utility.
I do not foresee your action of upholding this veto as ruling out
but I do believe that the Plan Commission and Common Council
the option of certain properties to participate in the program,
should react to those requests on a per parcel basis.
