WHEREAS, James, Jack, Douglas and Nancy Verburgt are owners of

WHEREAS, the above named owners are in the process of dividing
said lands; and I

WHEREAS, many of the divided lots already contain homes that may
be sold to persons whom already own said buildings; and
WHEREAS, the above owners of said real estate have requested that
the City divide the above special assessments so that said
assessments are divided among the parcels in question in what the
owners believe is an equitable proportioning of said assessments.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City
of Muskego as follows:
1. Upon the following terms and conditions being performed by
of assessment and assessment of the land in question will
the owners to the sole satisfaction of the City, the lien
be divided as stated on Exhibit A attached hereto and made
a part hereof as soon as can be accomplished by the
City. The terms and conditions to be performed by the
owners to the City's sole satisfaction are:

The owners shall give the City satisfactory evidence
of sole ownership of all the lands in question and the
right to divide such assessments as proposed; and
The lands shall be divided and all appropriate
documents making such division shall be filed and
recorded; and
All of the above terms and conditions shall be
accomplished to the satisfaction of the City on or
before the 1st day of November, 1986 or this
resolution is null and void and of no affect; and
James, Jack, Douglas and Nancy Verburgt accept this
resolution and agreement.
James, Jack, Douglas and Nancy Verburgt hereby waive
all legal notices required to amend or change special
assessments and agree to this special assessment
without further action by the City.
