THE CITY OF MUSKEG0
WHEREAS, a settlement has been reached between the Finance
Muskego Professional Policeman s Association, and
committee of the City of Muskego and the negotiators for the

THEREFORE, BE IT RESOLVED that the Common Council of the City of

January 1, 1985 through December 31, 1986.

B. Section l(a) - Hours of Work. The parties agree to add
the following Section F:
"Any officer temporarily assigned to investiga-
tory juvenile work shall receive his regular rate
of pay. In the event the temporary assignment
extends beyond ten (10) calendar days, the offi-
cer shall receive the rate of pay of the classi-
fication to which he is temporarily assigned."
C, Section l(a) - Hours of Work. The parties agree to add a
new Section G to read as follows:

"Officers shall be given reasonable notice in the
event of a temporary change in shift assignment.
Reasonable notice is defined as at least forty-
eight (48) hours before the scheduled new start-
ing time or old starting time, whichever provides
for greater notice. Any officer given less than
forty-eight (48) hours notice shall be paid at
one and one-half (1;) times his regular rate for
all hours worked outside his or her normal shift
within forty-eight (48) hours of the notice. In
the event of a temporary shift assignment beyond
ten (10) days, an officer can elect to, bump a
less senior officer who will then be asS$gned to
the temporary shift assignment."
D. Article V, Section 4 - Holidays. The parties agree to
amend the first paragraph of this Section, to read as
follows:

parties agree to amend the health and welfare language as

LETTER OF UNDERSTANDING

This Letter of Understanding, entered into and agreed to
by the parties is to be attached to and made a part of the col-
lective bargaining agreement between the parties, having as its
effective dates January 1, 1985, through and including December
31, 1986. The purpose of this Letter is to solve, on an interim
basis, the questions raised by recent Supreme Court decision
overturning the Constitutional exclusion of municipal government
from the Fair Labor Standards Act. Since specific provisions of
the current collective bargaining agreement between the parties
may no longer be lawful under prior regulations issued by the
Department of Labor, while at the same time recognizing that such
regulations may be reviewed, amended, and reissued by the Depart-
ment of Labor, the parties agree that the best course at the pre-
sent time is as follows:
That the provisions of Article V, Section 2 - Overtime,
which provides for the payment of overtime in the form of compen-
satory time off, will no longer be followed by the parties for an
indefinite period of time. That at such time as the Department
of Labor either reaffirms or reissues regulations concerning the
use of compensatory time off for police officers, employed by lo-
cal governments, the parties shall meet within twenty-one (21) -0 days of the issuance of such regulations to negotiate new con-
tract language regarding the use of compensatory time off. In
the event such regulations provide for the use of compensatory
time off, as a payment of overtime, in the manner fully consist-
ent with Article V, Section 2, in the manner in which Article V,
Section 2 has been enforced in the past, then the parties shall
not be required to meet and the City shall comply in all respects
with Article V, Section 2.
The parties understand and agree that during such time as
the compensatory time off provisions of Article V, Section 2 of
the contract are under suspension, the City shall comply in all
other respects with Article V, Section 2, in the manner in which
it prescribes under what conditions time and one-half (14) shall
be paid for any overtime worked.
