CCR1985133RESOLUTION 11133-85 PRELIMINARY RESOLUTION DECLARING INTENT TO EXERCISE SPECIAL ASSESSMENT POLICE POWERS UNDER SEC. 66.60, WIS. STATS. AS TO ROAD ASSESSMENT AREA FOR PROJECT MR-1-85 e RESOLVED by the Common Council of the City of Muskego, Wisconsin: 1. The Common Council hereby declares its intention to exercise its police power under sec. 66.60, Wis. Stats., to levy area for special benefits conferred upon such property by special assessments upon property within the following described described as follows: reconstruction of a roadway in the MR-1-85 assessment area Roadway Reconstruction Assessment Area Bay Lane and Bay Court - MR-1-85 All that part of the North 112 of Section 15, Town 5 North, Range 20 East, City of Muskego, Waukesha County, Wisconsin, described as follows: All abutting properties along Bay Lane Place and Bay Court from South of the North Line of said Section 15 South to and along the Shore of Bass Bay. Also those properties that lie Easterly of Bay Lane and Northerly of Bay Court known as Tax Key Number(s) 2217.990, 2217.991, 2217.992, 2217.993 and 2217.984. (Also see attached map.) 2. The Common Council determines that the improvements constitute an exercise of the police power and the amount assessed shall be based as follows: a. 113 of the total cost on a front foot basis against those parcels abutting the road b. The remaining 213 of the total cost on a per improvement; and attached hereto and marked Exhibit "A", lot basis, a lot being as shown on the map except as to the following parcels which are determined to be the following number of lots as they may be so divided under the present zoning regulations: 2217.990 - 2 2217.991 - 3 2217.993 - 3 in annual installments. 3. The assessment against any parcel may be paid in cash or consist of: 4. The City Engineer shall prepare a report which shall a. Final plans and specifications for the improvements. b. Entire cost of the proposed roadway project. c. Schedule of proposed assessments. -2- 5. When the report is completed, the City Engineer shall file a copy of the report with the City Clerk for public inspection. Clerk shall cause notice to be given stating the nature of the 6. Upon receiving the report of the City Engineer, the proposed improvement, the general boundary lines of the proposed assessment area, including a small map thereof, the time and place at which the report may be inspected, and the time and place of the public hearing on the matters contained in the published as a class 1 notice and a copy shall be mailed at least preliminary resolution and the report. This notice shall be 10 days before the hearing to every interested party. 7. The hearing shall be held in the Council Chamber of the 66.60(7), Vis. Stats.
