CCR1985063... . RESOLUTION 1\63-85 DENIAL OF REZONING REQUEST (R. Klenz - RS-1 to RS-3) WHEREAS, the City has received a petition from Robert Klenz Realty to rezone a parcel of land located on the corner of Martin Drive and Southern Drive from RS-1 to RS-3 to permit a two parcel division, and WHEREAS, the necessary public hearing has been held, and WHEREAS, the Plan Commission has recommended denial, and WHEREAS, a previous request for rezoning from RS-1 to RS-2 was denied on 3/28/78 because the existing duplex located on the Use it would require double the land area required for single property is a non-conforming use and if it became a Conditional family use, and WHEREAS, the RS-3 zoning would create a higher density than RS-2. THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego, upon the recommendation of the Plan Commission, does hereby deny the petition of Robert Klenz Realty to rezone the property at 568 W16949 Martin Drive from RS-1 to RS-3, because the existing duplex located on the property is a non- conforming use, and the RS-3 zoning would create a higher density than RS-2 which was previously denied.
