REAFFIRMING DENIAL OF LEGAL LOT STATUS - RON FORD
WHEREAS, in Resolution #165-82, dated September 14, 1982,
the Common Council denied a request for Legal Lot Status
on the Ron Ford property, Topaz Drive, with Tax Key No.
2174.978 just west of the Jewel Crest Subdivision, because
this lot is 53% of the required area, triangularly shaped

WHEREAS, the property was subject to foreclosure, and
WHEREAS, we have received correspondence from the Citizens
Bank of Mukwonago that they were unaware of the existing
covenant, and
WHEREAS, it is the opinion of the City Attorney that the
documents were recorded and apparently the title company
missed this recording, and
WHEREAS we have received a request from the Citizens Bank
of Mukwonago, who foreclosed on the property, to lift the
covenant which is in effect for twenty-five years, and
WHEREAS the Plan Commission of the City of Muskego reconmended
Reaffirming Denial of this Legal Lot Status in Resolution
#P. C. 68-83, adopted July 5, 1983.
THEREFORE BE IT RESOLVED that the Common Council of the City
of Muskego, upon the recommendation of the Plan Commission,
does hereby reaffirm Denial of Legal Lot Status for the Ron
west of the Jewel Crest Subdivision because this lot is 53% of
Ford property, Topaz Drive, with Tax Key No. 2174.978 just
the required area, triangularly shaped and incompatible with
the existing lots and building development in the immediate area
of his RS-2 District.
