APPROVING DEFERRED ASSESSMENT FOR PROPERTIES
OWNED BY GEORGE AND ALVIN SCHAEFER (W187 S7791 Lions Park Dr. )
WHEREAS, the city currently has a special assessment lien for
sewers on the following described red.estatelocated within the
City of Muskego
Town 5 North, Range 20 East, consisting of 128 acres,
South 3 of the Southwest and Southeast of Section 8,
a/k/a the Schaefer Farm, City of Muskego, Waukesha
County, Wisconsin
and
WHEREAS, the owners of said real estate, George and Alvin Schaefer,
have requested the city to defer said special assessments under
the provisions of Section 66.605, Wisconsin Statutes, and
WHEREAS, said George and Alvin Schaefer have made application to
the city for an extension of time within which to pay the special
assessments that have been levied against said property, which
consists of the following
$11,730.40 - special assessment $16,704.75 - special assessment
938.43 - interest 1,336.38 - interest
$ 12,668.83 - total assessment $ 18,041.13 - total assessment
and
WHEREAS, a moratorium placed on the sewer district of the City of
Muskego by the DNR prohi,bit~..the-'dev-e.lo$m_enLof .ae. property and
and therefore the use of the installed sewers, and
WHEREAS, on the 9th day of October, 1979, the Common Council adopted
Resolution #191-79 which provided an additional two year deferment
of special assessments at a rate of 6 percent per annum because of
litigation in which the Schaefer's were involved, and
WHEREAS, the Common Council has previously granted an additional
commenced on the date the previous deferment expired, and
10-year deferment to other property owners whereas that deferment
WHEREAS, the initial 10-year deferment for the Schaefer property
expired on the 9th day of October, 1979,
WHEREAS, the Sewer Committee and the Finance Committee have
recommended that the action taken by the Common Council granting
a special two-year deferment be rescinded and that the special
of ten years effective 9th day of October, 1979
assessments against the Schaefer property be deferred for a period
NOW, THEREFORE, BE IT RESOLVED that the special assessments affecting
the George and Alvin Schaefer properties which were the result Of
certain sewer construction hereby is deferred for a period Of
ten (10) years from the date the previous deferment expires.

BE IT FURTHER RESOLVED that while said special assessment is out-
standing under the terms and conditions of this deferment the same
shall bear interest at the rate of nine (9) percent per annum
for the number of years and under the terms and conditions
provided in Resolution #19-71 as if this were the final resolution
except that the new rate of interest shall be from the date of
expiration of the previous deferment.
BE IT FURTHER RESOLVED that this action is taken pursuant to the
Establishing Deferred Assessment Policies.
