DENIAL OF GRIEVANCE
(Jean Marenda)
WHEREAS Jean Marenda has filed a grievance with the City of
Muskego in respect to the following: That Section 16.B 5
Regular Parttime Employees, covered by this agrqement "shall
receive all fringe benefits specified here on a prorated
basis", and
WHEREAS, she claims that at the present time fringe benefits
referred to as the Retirement Program, Article 4, Section
4.01, and Insurance, Article 18, Sections 18.01, 18.02, 18.03, 18.04 and 18.05 are not received by parttime employees and
WHEREAS, Mrs. Marenda further grieves that since she is a
regular parttime employee working 20 hours or more she is
eligible for a portion of those benefits, and
WHEREAS, the Finance Committee, upon the advice of their
negotiating attorney has recommended denial of the grievance,
THEREFORE, BE IT RESOLVED that the Common Council of the City
hereby deny the grievance submitted by Jean Marenda
of Muskego, upon the advice of its negotiating attorney, does
BE IT FURTHER RESOLVED that this denial is based on the following
reasons:
and the Milwaukee Area Public Employees Local 2414 states, "the
1. Section 24.01 of the agreement between the City of Muskego
representative shall present the grievance to the department
agrieved employee, the Union Committee and/or the Union
head within sixty(60) calendar days of the date the employee knew or
should have known of the occurrence of the event causing the
grievance or misunderstanding.
2. Section 4.01 of the agreement states "The present retirement
program shall be continued during the life of this agreement. etc."
3. Resolution #74-68 authorizing submittle of a retirement program
for city employees by Lincoln National Life Insurance Company
specifically provides that the retirement plan shall be for full-
time employees, and
4. The trust agreement executed between the City of Muskego and the
City of Muskego Pension Trust specifically states in Section 2.05
"employee shall mean any person who is regularly employed by the
customary employment is for not more than 20 hours in any one week
employer on a fulltime basis excluding such persons whose
or for not more than five months in any calendar year.
