RESOLUTION #213-78
AUTHORIZING EXECUTION OF A CONTRACT WITH
DAVID SCHREIBER & ASSOCIATES
(Re: Bluhm Park)
WHEREAS, the Park and Recreation Board has determined that a
second baseball complex will be needed in the near future, and
WHEREAS, they have recommended the Common Council approve
of an agreement between David Schreiber & Associates and the
City of Muskego whereby David Schreiber & Associates would
prepare a master plan for the 80 acre former Bluhm farm
located at the intersection of McShane Dr.and Fairfield .
Dr. which would include a baseball complex, and
WHEREAS, all agreements must be executed by the Mayor and
City Clerk after approval by the Common Council,
THEREFORE, BE IT RESOLVED that the Common Council of the City
of Muskego does hereby authorize the Mayor and Clerk to
execute an agreement between the city and David Schreiber &
Associates for the purpose of preparing a master plan for
the 80-acre Bluhm Farm owned by the city which would include
a baseball complex.
BE IT FURTHER RESOLVED that said agreement is subject to the
approval of the City Attorney

AGREEMENT
THIS AGREEMENT entered into this __ day of , 1978, by and
between the City of Muskego (hereinafter called the Owner), and David Schreiber
& Associates, 20 North Carroll Street, Madison, Wisconsin (hereinafter called a the Consultant).
WITNESSETH.
That the Owner does hereby employ the Consultant to prepare a Master Plan for
the 80-acre Blum Farm located at the intersection of EicShane and Fairfield Drive
in the City of Muskego, Wisconsin.
ARTICLE 1: SERVICES
The Consultant agrees to provide the following professional design services
and materials to the Owner:
A. Background Studies
1. Review the project site to become generally familiar with its layout
and relation to adjoining land uses.
2. Review the community's Comprehensive Outdoor Recreation Plan to
determine the relationship of the proposed park site with other
community recreation sites.
3. Consult with the Park Board regarding proposed facilities for the
new park and community recreation needs which might be met with the
development of the new park.
E'. Site Review
A detailed office and field investigation will be made to document the
following site conditions.
1. Existing soils and their ability to support the intended development.
2. Site drainage and topography.
3. Existing vegetation and its quality.
4. Site orientation to the sun and wind patterns
5 Area traffic patterns and vehicular and pedestrian access to the site.

C. Design Development
Based upon the information gathered in Items A & B above, David Schreiber &
Associates shall work closely with the Park Board and Park and Recreation
Director to prepare the following plans:
1. Conceptual Design:
a. Consultant shall consider various design alternatives illustrating
land use and site circulation. e b., Alternative studies shall be presented to the Park Board for
their consideration.

Upon selection of a suitable design alternative, a preliminary
master plan shall be prepared, illustrating the overall project
character and defining individual facilities.
Submitted with the preliminary plan shall be a cost estimate and
phasing program. In developing the phasing program, the Con-
sultant shall work closely with the Park and Recreation Director
to determine community priorities.
The preliminary master plan along with cost estimate and phasing
program shall be submitted to the Park Board for their approval.
(Note: this would also be the appropriate point to consider a
public hearing on the project).

3. Final Plan and Plan Materials.
a. Based upon the recommendations of the Park Board, revisions shall
be made to the preliminary Inaster plan, cost estimate and phasing
program, and the final plan and related materials prepared.
b. Final plan subn~ission and materials shall include:
- One reproducable copy of the final master plan.
- Fifteen copies of the final plan reduced to 8%" x 11" and
bound with the cost estimate and phasing program.
ARTICLE 2: AOOITIOMAL SERVICES
A. Should,the Owner desire additional services beyond those outlined in
Article 1 above, such services shall be provided on an hourly basis,
plus expenses, as defined in Article 5. -e
ARTICLE 3: ITEMS TO BE FURNISHED BY THE OWNER
A. Site boundary and topographic survey.
B. Location and description of all utilities and easements

ARTlCLE 4: TIME SCHEDULE
A. Work shall begin within 45 days of the date of this Agreement.
B. Conceptual designs shall be presented within 60 days of the date of
this Agreement.
C. ProjIect completion shall be within 120 days of the date of this Agreement.

ARTICLE 5: FEES
A. In consideration of the services described in this Agreement, the City
of Muskego would pay David Schreiber & Associates on an hourly basis,
plus expenses, to a maximum fee of FOUR THOUSAND SEVEN HUNRED FIFTY
DOLLARS ($4,750.00).
B. Hourly rates and expenses would be calculated from the following schedule;
Principal $ 20.00
Landscape Architect 15 00 - 17.50
Draftsman 12 50
Secretary 8.50
Reimbursable Expenses (prints, Xerox,
photos, telephone, meals) at cost
Travel .15/mile
C. For additional services not contained in this Agreement, fees would be
determined on an hourly basis, plus expenses, from the schedule described
in I'tem B above.
D. Statements detailing the previous month's services will be issued at the
begilnning of each month. Payment is due within 30 days of the statement
date.
ARTICLE 6. ABANDONMENT OF PROJECT
If the Owner finds it necessary to abandon the project, such notice shall be
given in writing and the Consultant shall be compensated for all work completed
under Arti,cle 1. Scheduled items not completed, but upon which work has been
performed, shall be paid for upon the bzsis of estimated extent of conlpletion
ARTICLE 7: OTHER PARTIES
\e Neither the Owner nor the Consultant shall assign, sublet, or transfer his
interest i'n this Agreement without the written consent of the other.
ARTICLE 8: TERMINATION
The Agreement shall be terminated at any time by the Owner or the Consultant
Agreement, unless previously terminated by written notice, shall be terminated
upon givin'g written notice. Telmination shall comply with Article 6. This
