AUTHORIZING THE PURCHASE OF LOT 4, BLOCK 15
JEWEL CREST SUBDIVISION
(Adjacent to Jensen Park)
WHEREAS, it has been determined that a portion of the Jensen
Park parking lot is located on private property as well as
the fire escape serving the Jensen Park recreation building,
and
WHEREAS, it was determined that it would be in the best
Block 15, Jewel Crest Subdivision, in order that a portion of
interest of the city to negotiate with the owners of Lot 4,
that lot can be purchased by the city, and
WHEREAS, the City Attorney has agreed, subject to ratification
by the Council, to purchase that portion of Lot 4, Block 15,
Jewel Crest Subdivision, upon which a parking area encroaches,
for $3,000.00 and further, that the purchase would be subject
to the execution of an easement from the owners of Lot 4.
WHEREAS, the Finance Committee and the Park and Recreation Board
has recommended approval of the purchase,
THEREFORE, BE IT RESOLVED that the Common Council of the City
of Muskego does hereby agree to purchase that portion of Lot 4,
Block 15, Jewel Crest Subdivision, *which has the parking lot
encroachment upon it forthe amount of $3,000 00.
BE IT FURTHER RESOLVED that this agreement to purchase is subject
to the execution of an easement over the lands which have the
fire escape encroachment
BE IT FURTHER RESOLVED that the Mayor and Clerk are authorized
to execute the necessary documents in the name of the city.
BE IT FURTHER RESOLVED that the Clerk is authorized to transfer
Fund (#275) to the Park and Recreation Department's Capital
the sum of $3,000 00 from the Capital Improvement Contingency
Budget.
