BE IT RESOLVED that the Common Council of the City
of Muskego, upon the recommendation of the Finance Committee,
does hereby approve of the attached lease agreement between
Richard Schaumberg and the City of Muskego Park and Recreation
c Board.

LEASE AGREEMENT 0
THIS AGREEMENT is made between the City of Muskego,
The property which is the subject of this lease is
Park Recreation Board, Lessor, and Richard Schaumberg, Lessee:

described as follows, to-wit:
Lands donated to city for park purposes in
Freedom Square - Phase IV
RENTAL: The rental for said property shall be the
sum of $180.00 for a term of one year, commencing on the 1st
day of June, 1977, and ending the 31st day of May, 1978,
PURPOSE OF LEASE: The Lessor leases the premises
and the Lessee agrees to use the premises for the grazing and
pasturing of horses owned by the Lessee, but never shall the number
of horses on the leased premises be more than four (4) at any
one time. %e Leesee shall also use the prcmises for the pur-
pose of recreation connected with the horses and for himself
and family and guests and shall never use the premises or the
horses for commercial purposes on CIIC premises.
CONDITIONS: Lessee shall prior to the use of the
premises as ab ove described and stated, erect fences, the
material and type of which shall be approved by the Lessor
and &ich shall be sufficient to keep the horses within the
confines of said fences. Any gates provided to the premi.ses
shall be secured by locks and Lessee shall he responsible for the
the maintnnance ard repair of said fences at all times. Any
fences or other equipment used by the Lessee during the term
of the lease or a renewal thereof shall at the opti.on of the
city be removed by him at the expiration thereof.
LIABILITY INSURANCE: Lessee, shall, at his own
expense, at all times during the te~m of this lease, nlaj.nt;lin
in force a policy or policies of insurance, written by one or
more responsible insurance carriers, which will insure Lessor
against liability for injury to or death of persons or loss
or damage to property occuring in or about the demised pL-elni ses.
The liability under such insurance shall not be less than
$100,000 for any one person killed or injured, $200,000 for
any one accident and $50,000 property damage.
ASSIGNb7ENT: This lease shall not be assigned by the
Lessee without the express written consent of the Park Board.
ENEL!AL: This lease is not subject to automatic
renewal, but may be renewed by the Park Board with the approval
of the Comon Council on an annual basis upon such terms and
conditions as the parties may agree to.
Pursuant to Resolution # 107-77passed and approved
by the Common Council of the City of Muskego, this. lease is
hereby executed this \()=day of May, 19 77.
