APPROVING AMENDMENT TO LAKE LORE PLANNED
UNIT DEVELOPMENT AGREEMENT e
WHEREAS on the 14th day of September, 1976, the Common
Council adopted Resolution #178-76 approving the
Developer's Agreement (including an Open Space Agreement)
for Lake Lore Estates Subdivision, and
WHEREAS, that agreement included provisions for the
Lore Estates Subdivision which did not provide for the
construction of tennis courts on Outlot #1 of the Lake
use of the tennis courts by the residents of Tudor Oaks,
and
WHEREAS, the developers of Lake Lore Estates and the
owners of Covenant Living Centers, Inc. would like to
would be available to the residents of Tudor Oaks, and
amend the agreement in order that the tennis courts
WHEREAS, provisions of the amendment protects the city
by providing that the residents of Lake Lore Estates and
in the event the tennis courts were not properly maintained
the owners of Tudor Oaks could be assessed for the cost
of any maintenance performed by the city, and
WHEREAS, the City Attorney has approved of the proposed
amendment,
THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego does hereby approve of the proposed
amendment to the existing Developer's Agreement and/or Open
Lake Lore Estates Planned Unit Development.
Space Agreement between the city and the developers of
BE IT FURTHER RESOLVED that the Mayor and Clerk are
authorized to execute the proposed amendment to Lake Lore
Estates.
