RESOLU'TION # 216-76
RESOLUTION OF NECESSITY (Ceille)
WHEREAS, public necessity demands that sanitary sewer service
be extended within the City of Muskego and that the City acquire the
necessary permanent easements required for the extension ofsaid sewer
service,
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the
City of Muskego, Wisconsin, that is is necessary in the public interest
that the following permanent easements in the following described lands
be acquired for the purpose of the extension of sanitary sewer mains
in, across and upon said lands and that the attached Relocation Order
for the purpose of establishing, Laying out, extension, construction,
reconstruction, improving, or maintaining of said sanitary sewers be
approved.
AND, BE IT FURTHER RESOLVED, that the City Attorney and Mayor
are hereby authorized and directed to negotiate for the acquisition of the
permanent easements in said lands required for the extension of said
sewer mains, and in the event permanent easements in said lands can not
be obtained by negotiation, the City Attorney is authorized and directed
to take by condemnation those lands required for said easements.
The lands required for the said easement are described on
Exhibit "A" attached hereto and incorporated herein by reference.

BY THE COMMON COUNCIL OF THE CITY OF MUSKEGO
THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN, finds and
determines that:
The proper establishing, laying out, widening, enlarging,
extending, construction, reconstruction, and improvement and maintaining
of certain sanitary sewers located within the City of Muskego requires
the acquisition of a permanent easement in lands shown on the map
hereto attached and marked "Sanitary Sewer System Map #9, City of
Muskego--Ceille property".
The Common Council of the City of Muskego, thereby orders
that:
I. The said easement is hereby laid out and established
to the I ines and widths as shown on sa id map;
2. The required lands or interest in said lands as shown on
the map shall be acquired pursuant to the Wisconsin Statutes.

PERMANENT SANITARY SEWER EASEMENT
A 30.00 foot wide strip of land being located in all that
part of the Southeast 1/4 of Section 11, Town 5 North, Range
20 East, City of Muskego, Waukesha County, Wisconsin, the
centerline of which is described as follows:
Commencing at the East 1/4 corner of Section 11; thence
Southerly along the East line of the Southeast 1/4 of
Section 11, 28.36 feet to the place of beginning of said
centerline; thence South 48" 30' West, 198.48 feet to the
end of said centerline.
Together with a 10.00 foot wide temporary sanitary sewer
construction easement lying on both sides, being parallel
and adjacent to the above described permanent sanitary
sewer easement.

centerline of which is described as follows:
Commencing at the most Southerly corner of Block "O", Freedom
Acres" a recorded plat being located in all that part of the
Southeast 1/4 of Section 11, Town 5 North,- city of Muskego,
Waukesha County, Wisconsin; thence South 38' 32' East, 30.00
feet to the place of beginning of the centerline to be
described; thence along the arc of a curve, 107.93 feet,
