APPROVAL OF FINAL PLAT OF KRISTIN DOWNS
WHEREAS, on the 3rd day of September, 1974, and on the 14th
day of January, 1975, the Plan Commission and Common Council,
respectively, approved the planned unit development as presented by
MC Development Co., Inc., for Kristin Downs, and
WHEREAS, the Common Council, on January 14, 1975, indicated
the City's intent to permit connection into the municipal sewer
system by adoption of Resolution #5-75, subject to the requirement
that the final plat be submitted within six months, and
WHEREAS, on May 20, 1975, and on June 10, 1975, the Plan
Commission and Common Council, respectively, approved the preliminary
plat of Kristin Downs subdivision, and
8195-75, granting a six month I s extension of the time required to
file the final plat (December 10, 1975), and
WHEREAS, on July 22, 1975 the Common Council adopted Resolution
WHEREAS, on the 6th day of November, 1975, the Public Works
Committee approved the road grades, the drainage plans and the
utility plans for Kristin Downs subdivision subject to several
changes which have been accepted by the developer, and
WHEREAS, on the 20th. day of April, 1976, the Plan Commission
recommended to the Council approval of the final plat of Kristin Downs subdivision.
THEREFORE BE IT RESOLVED that the Common Council of the City
hereby approve the final plat of Kristin Downs subdivision.

BE IT FURTHER RESOLVED that this approval is subject to the
submittal of an acceptable developer's agreement, open space agreement and deed restrictions.

BE IT FTJRTHER RESOLVED that the financial guarantee as required in
the City of Muskego's Land Division Ordinance for completion of
utilities, amenities and landscaping plan shall be of a sufficient
amount to assure completion of the landscaping plans with its
amenities approved by the Plan Commission. Also, that 12yL of the
amount of the contract for grading of open spaces and the installation
of amenities shall not be released to the developer until such improve-
ments are approved by the city.
BE IT FURTHER RESOLVED that this approval is subject to acceptance
of the proposed water system by the city's engineering firm of Ruekert
and Mielke and the extension of lot lines by metes and bounds descriptio1
in outlots 1 and 3 with the developer accepting the responsibility to
complete the landscaping required in outlot 3 to protect adjacent
properties from inadequate drainage.

BE IT FURTHER RESOLVED that this approval does in no way relieve
the MC Development Corporation, Inc., of its responsibility to meet
the requirements of the Muskego Zoning Ordinance as it relates to
