AUTHORIZING EXECUTION OF LEASE AGREEMENT BETWEEN
CITY OF MUSKEGO AND ALFRED BADERTSCHER
(Outlot - Ridges Subdivision)
BE IT RESOLVED that the Common Council of the
City of Muskego, upon the recommendation of the Finance
Committee, does hereby approve of the attached lease
agreement between City of Muskego and Alfred Badertscher.

LEASE AGREEMENT /
e '.THIS AGREEMENT is made between the City of Muskego, Lessor,
and Alf.red Badertscher, Lessee:
The property which is the subject of this lease is described
as follows, to-wit: w 26 acres of the former Grober property as shown as the outlot in The Ridges Subdivision 6.
RENTAL: The rental of said property shall be the sum of
$200.00 for a term of one year, commencing on the 1st day of
June, 1975, and ending the 31st day of May, 1976.
PURPOSE OF LEASE: The Lessor leases the premises and the
Lessee agrees to use the premises for the grazing and pasturing
of livestock owned by the Lessee.
CONDITIONS: Lessee shall prior to the use of the premises
as above described and stated, erect fences which shall be sufficient 0.. to keep the livestock within the confines of said fences. Any gate
provided to the premises shall be secured by locks and Lessee shall
be responsible for the maintenance and repair of said fences at all
times. Any fences or other equipment used by the Lessee during the term
of the lease or a renewal thereof shall at the option of the city be
removed by him at the expiration thereof.
Lessee shall control all noxious weeds,
Lessee shall be whatever means necessary (fence, etc.) protect
the stream and several large springs from damage by livestock.
LIABILITY INSURANCE: Lessee, shall at his own expense, at
all times during the term of this lease, maintain in force a
policy or policies of insurance, written by one or more responsible
insurance carriers, which will insure Lessor against liability for
injury to or death of persons or loss or damage to property occurring
in or about the demised premises. The liability. under such insurance
shall not be less than $100,000 for ;any one person killed or injured,
$200,000 for any one accident and $50,000 property damage.
ASSIGNMENT: This lease shall not be assigned by the Lessee
without the express written consent of the City of Muskego.
RENEWAL: This lease is not subject to automatic renewal, but
may be renewed by the Common Council on an annual basis upon such
terms and conditions as the parties may agree to.
Pursuant to Resolution R143-75 passed and approved by the
Common Council of the City of Muskego, this lease is hereby executed
this 27th day of May, 1975
