Affumation of Declared Intent to Levy Special Assessments,
Contingent Authorization of Notice of
Public Hearing, and Contingent
Authorization of Advertisement of
Public Work for Bids (Guernsey Meadows)
WHEREAS, Rite Realty Corp., as subdivider, has proposed a preliminary plat for
the first 71 lots (“Phase I” or the “Subdivision”) of a 105-lot subdivision to be known as
Guernsey Meadows.
WHEREAS, said subdivider desires to make provision for the installation and
construction of site improvements in the Subdivision and to that end has requested that
the City of Muskego let contracts for the work and levy special assessments to cover the
cost thereof against the lots in the Subdivision to be benefited thereby, and
WHEREAS, this Common Council on February 1 I, 1975 adopted a preliminary
resolution by which the City declared its intention to exercise its special assessment
powers as the fust step in the proceedings for levying such special assessments,

NOW, THEREFORE, BE IT RESOLVED, that this Common Council
hereby reaffirms its intention, provided a Subdivision Agreement and a
final plat are approved by this Common Council and final engineering
plans and specifications for the work are approved by the City Engineer
and the Plm Commission all with such changes and subject to such
conditions as may be required or imposed, to exercise the powers
conferred upon the City of hskego by Section 66.60 of the
Wisconsin Statutes, for the purpose of levying special assessments to cover
the cost of construction and installation of some or all of the
improvements to be listed in said Subdivision Agreement, to serve some or
all of the properties within the Subdivision, including sanitary sewer
mains, sewer and water laterals, surface water drainage facilities, road
grading, road base and road paving, and the engineering costs attributable
to such improvements, all to benefit lots within the proposed Subdivision.
FURTHER RESOLVED, that the proposed assessment district shall consist
of all of the lots in the proposed Subdivision to be known as “Guernsey
Meadows” or more specifically as “Phase I I” thereof, as reflected on the
Preliminary Plat.
FURTHER RESOLVED, that this Common Council intends that said
assessments, when levied, shall be made payable in five annual installments
together with interest, all as provided in Sections 66.54(7), 66.60(7) and
66.605 of the Wisconsin Statutes.
FURTHER RESOLVED, that the City Engineer shall cause to be prepared
a Report of such work, the Report to be filed with the City Clerk for
public inspection, all as provided in Sections 66.60(2) through 66.60(4) of
the Wisconsin Statutes.
WHEREAS, upon the completion and filing of the Report required by Section
66.60(3) of the Wisconsin Statutes, a public hearing is required by Section 66.60(7) to be
held upon the proposed public improvements and assessments on at least ten days’
published notice,
NOW, THEREFORE, BE IT RESOLVED, that when the Report required
by Section 66.60(3), Wisconsin Statutes, shall have been completed and
filed with the City Clerk for public inspection the City Clerk shall
thereafter cause to be published once in the Muskego Szm, the official
newspaper of the City of Muskego, and shall cause to be mailed to every
interested person whose post office address is known or can reasonably be
ascertained, a Notice of Hearing in substantially the form attached to this
resolution as Exhibit A and made a part hereof, said Notice of Hearing to
set forth the time and date of the public hearing on the evening of a
regularly scheduled meeting of the Common Council scheduled to take
place, at least ten days after and no more than forty days ,after
publication and mailing of the required Notice of Hearing.
FURTHER RESOLVED, that a public hearing shall be held before this
Common Council on the evening of such regularly scheduled meeting of
this Common Council as shall be stated in the foregoing Notice of
Hearing, at the City Hall in the City of Muskego, at which persons
interested, or their agents or attorneys, may appear before this Common
Council and be heard concerning the proposed public improvements, and
plans and specifications therefor and assessments to be made of the
benefits accruing therefrom, as described generally in this resolution and
more specifically the Report referred to above.
WHEREAS, in order to expedite the work and to give prospective bidders ample
time in which to submit bids, it is deemed desirable to publish the advertisement for bids
prior to soch public hearing, subject to the reservation by the City of the right to reject
bids as set forth below,

NOW, THEREFORE, BE IT RESOLVED, that after the plans,
specifications, form of contract and bond, bidding documents and form of
advertisement shaU have been approved by the City Engineer and by the
Public Works Committee, placed on file with the City Clerk for the
inspection of bidders, said Committee or the City Clerk on its behalf shaU
cause to be published an advertisement for bids for the construction and
completion of the aforementioned public improvements, in the Muskego
Sun, the official newspaper of the City, once a week for two consecutive
weeks, such publications to be on dates such that the first publication
shall be no later than 14 days prior and the second no later than 7 days
prior to the date established below for opening bids.
FURTHER RESOLVED, that the publication of such advertisement shall
be subject to the provision therein that the City reserves the right to reject
any and all bids for any reason, including the reason that after the
aforementioned public hearing it elects not to proceed with the work
described in said advertisement.

FURTHER RESOLVED, that nothing contained in these resolutions shall
commit the City to take any action other than that herein expressly
authorized.
FURTHER RESOLVED, that the sealed bids and proposals received in
response to the advertisements for bids authorized above shall be received
by the City of Muskego at the City Hall until a date and time prior to the
public hearing which shall have been noticed with respect to the proposed
improvements. Said final date and time for receiving bids shall be stated in
the advertisements for bids, and the bids shall be opened at such date and
time by the Mayor, City Clerk, and City Engineer.
