DECLARING A MORATORIUM ON NEW SUBDIVISIONS
IN THE NORTHWEST SEWER DISTRICT OF
THE CI'IY OF MUSKEGO e WHEREAS. there has been an increasinp. number of reauests for - permission to subdivide lands within the district presently
being served by the northwest oxidation system, and
WHEREAS, it has been determined that those areas already
committed for sewers by the Council and which are or will
be treated by the oxidation treatment plant places the flow
of sewage very near the established capacity or 750,000
gallons per day, and
WHEREAS, the Sewer Committee has recommended that a moratorium
be placed on all new subdivisions as defined in Chapter 18.05
of the Municipal Code, Subdivision and Platting (The division of
a lot, parcel, or tract of land by the owner thereof or his
agent for the purpose of sale or of building development, where:
(a) The act .of division creates 5 or more parcels or
(b) Five or more parcels or building sites of 1 1/2 acres
building sites of 1 1/2 acres each or less in area; or,
each or less in area are created by successive divisions
within a period of 5 years.)
which would include lands that could be served (if there were
capacity) by the northwest oxidation system until August 1, 1973,
in order to give the city and its consulting engineers the
opportunity to evaluate the effectiveness of treatment at its
present level as well as its maximum level and whether or not
there are realistic methods of providing additional capacity to
that treatment system.
THEREFORE, BE IT RESOLVED that the Common Council of the City
of Muskego does hereby declare a moratorium on all new subdivisions
as defined in Chapter 18.05 of Municipal Code, Subdivision and
Platting, which lie within the district presently being served by
the northwest oxidation system until August 1, 1973.
BE IT FURTHER RESOLVED that the Common Council at that time will re-
evaluate its position based on studies undertaken by the Sewer
Committee and the city's consulting engineers to determine the
effectiveness of the present treatment facility and the feasibility
of increasing the capacity of the northwest treatment system.
