ESTABLISHING GUIDELINES FOR THE APPRDVAL OF
NEW DEVELOPMENTS WHICH WILL BE USING
THE CITY'S SEWERAGE FACILITIES
WHEREAS, the City of Muskego is presently constructing a new sewerage
treatment facility to serve the northeast district of the city and
is building an addition to the existing northwest sewerage treatment
facility, and
WHEREAS, the limitations of both plants require that the city establish
a policy regarding the development of lands within the area being
sewered in order to prevent overloading of the facilities which could
result in pollution of Big Muskego Lake and the Root River Watershed,
and
WHEREAS, it is recognized that although new developments in the sewer
assessment district should be given priority, there are also lands
outside of the assessment district which, if developed properly, could
be of benefit to the city, and
WHEREAS, the Common Council realizes that it is their responsibility
to take whatever action is necessary to assure continued industrial,
commercial and residential growth in the city by providing, where
possible, the sewerage treatment facilities needed to bring that growth,
THEREFORE, BE IT RESOLVED that the Common Council of the City of
Muskego does hereby establish the following guidelines which will be
used when considering proposed developments planning to use the city's
sewerage treatment facilities:

Proposed developments within the sewer assessment district
will be given priority with particular consideration given
to those lands which did not receive a deferred assessment.
All developments, except those on city-owned property, will
be limited to 65% of the permitted density as established by
the Zoning Ordinance.
No development will be approved if when 65% complete could
not be adequately served by existing sewerage treatment
facilities. In determining treatment capacity available,
existing commitments by the city as well as recorded lots
will be taken into consideration.
The Common Council will be receptive to developments outside
of the sewer assessment district if provisions are made to
treat the resulting wastes in off-peak hours so as not to
overextend the treatment facility's capacity.
BE IT FURTHER RESOLVED that the Common Council of the City of Muskego
does hereby. declare their intent to investigate the possibilities of
expanding the capacity of its sewerage treatment facilities and to take
whatever action is necessary, wfthin good planning concepts and economic
feasibility, to provide adequate sewerage treatment facilities to assure
proper growth of the city.

BE IT FURTHER RESOLVED that these guidelines will be reviewed annually
to determine their relationship to existing conditions.
BE IT FIJRTHER RESOLVED that this resolution will be transmitted to
the Plan Commission for their concurrence.
