CCR1971094RESOLUTION #94-71 (As Amended) RELATING To DEFERMENT OF SPECIAL ASSESSMENTS AGAINST FARM LANDS IN NORTHWEST ASSESSMENT DISTRICT e WHEREAS, on the 13th day of April, 1971, the Common Council adopted Resolution 866-71 determining to reopen and re- * consider the special assessments against the George Schaefer pro- perty, and place the same on a deferred payment basis pursuant to Resolution #19-71, which resolution established a deferred assess- ment policy for farm lands within the City; and WHEREAS, on the 27th day of April, 1971, pursuant to notice, a public hearing on Resolution #66-71 was held by the Common Council. e NOW, THEREFORE, BE IT RESOLVED, that pursuant to the authority given to the Common Council by Section 66.60 Statutes, and the established policy of the City herein referred to, that the schedule of special assessments levied in the Northwest District under Tax Key No. 2191.998 and under the following assess- ment key numbers be amended to provide as follows: Date of Levy Assessment Total Payment Key No. Assessment Method - 2-25-69 D-4 $ 10,148.00 Deferred 2-25-69 D-25 5,194.40 Deferred 5-26-70 E-189 18,014.75 Deferred ($16,704.75) That said assessments should be deferred on the following basis, to-wit: Pursuant to the terms of Resolution #19-71, which resolution is incorporated herein by reference as if fully set forth herein. That the remaining balance of the special assessment against Special Assessment E-189 in the amount of $1,310.00 all be paid in nine annual installments, the first of which shall be due and payable on the 28th day of February, 1972, and subsequent install- ments annually thereafter. Said assessments may be paid in nine annual equal install- ments, the first installment shall be due on the 28th day of February, 1971, and subsequent installments annually thereafter. Interest at the rate of 8 per cent per annum on the entire assessment shall be charged. The first installment due shall include interest on the entire assessment from the 1st day of May 9 1971, to the 31st day of December, 1971. Subsequent installments shall include one year's interest upon the unpaid balance of the assessment. The City Clerk is hereby directed to give notice of this installment assessment by publication of a copy hereof in the Lake- 0 land Hub, the official City newspaper which is likely to give notice to the persons affected, and by mailing a copy thereof to every interested person whose post office address is known, or can with reasonable dil- igence be ascertained. In all cases where owners of property against whom Assessments shall be made shall file with the City Clerk, within 30 days from the date of the aforesaid notice, a written notice that they elect to pay the special assessments upon their property on or before November 1, 1971, special assessments payable in installments shall not be made against said property of such a owners, and such owners shall pay the entire assessment in full. In the event a person so elects to pay such assessment on or before November 1, 1971, but fails to do so, the entire amount of such assessment, together with interest thereon from May 1. 1971 to December 31, 1971, at the rate of 8 per cent per annum, shall be entered in the tax roll for the year 1971 and collected as are other taxes of the City, on a 9 year installment basis. After the the for making such election shall have expired, such assessment shall be due and payable in installments as aforesaid, but any assessment may be paid in full before due only upon the payment of interest to date of prepayment upon such assessment, plus one year's interest on the then unpaid principal amount of such assessment.
