RESOLUTION LEVYING SPECIAL ASSESSMENT ON
PROPERTY IN ASSESSMENT DISTRICT #3

WHEREAS, a request has been made by the owner thereof
to allow him to connect to the sanitary sewer main fronting the
real estate described:
All that part of the NE+ of Sec. 9, T 5 N, R 20 E, in the City of
Muskego, Waukesha County, Wisconsin, bounded and described as
South along the East line of said Section 109.70 feet to the center
follows: Commencing at the East + corner of said Sec. 9; thence
I ine of C. T. H. "A". , thence S 63" 21' W, along said center line,
674.30 feet to the center line of a 50.00 foot drive lying West
of and adjoining the West I ine of the "Mich i PI at"; thence N 14"
33' W along the center line of said drive, 935.60 feet to a point,
which for future references shal I be designated as point "A";
thence N 78O 00' E, 73.63 feet to the place of beginning of the
parcel hereinafter described; thence continuing N 78" 00' E, 65.00
feet; thence N 8" 37' W, 235.51 feet to a point on the shore of
Little Muskego Lake; thence S 85" 34' W along said shore, 42.65
feet; thence continuing along the shore, S 1' 19' W, 112.25 feet;
thence continuing along the shore, S 88' 36' W, 3.03 feet; thence
S 8' 37' E, 132.27 feet to the place of beginning.
Also a right of way, to be used in common with others, over a
strip of land 30.00 feet in width, bounded and described as follows:
Beginning at point "A" in the above described parcel; thence N 78"
00' E, 303.81 feet; thence S 7' 22' E, 30.10 feet to the Northeast
corner of the Michi Plat; thence S 78" 00' W, along the North line
of said plat and extension thereof, 300.04 feet; thence N 14' 30.03
feet to the place of beginning.
WHEREAS, a Waiver of Notice of Special Assessment and
Hearings and the levying thereof has been filed with the City
Clerk by the owner;
NOW, THEREFORE, BE IT RESOLVED:
(I) For the purpose of paying a portion of the cost of
the construction and installation of a sanitary sewer collection
system within the City, there is hereby levied and assessed against

(2) There is further assessed the actual cost of the

ncidental costs of said installation, including attorney
ering fees and publication fees, if any.
(3) Said assessment may be paid in ten annual equal
installments, the first installment being due on the 1st day of
November, 1970, and subsequent installments annually thereafter.
Interest at the rate of six (6%) per cent per annum on the entire
assessment shall be charged. The first installment due shall in-
clude interest on the entire assessment from the &e hereof to
the 31st day of December, 1970. Subsequent installments shall
include one year’s interest upon the unpaid balance of the assess-
ment.
(4) The City Clerk is directed to give notice of this
assessment by mailing a copy of this resolution to the owner of
the property at his last known post office address or by personal 8 service upon the owner.
(5) If the owner of the property shall file with the
City Clerk within thirty days from the mailing or service of the
aforesaid notice, a written notice that they elect to pay the
special assessment upon their property on or before November I,
1970, special assessments payable in installments shall not be
made against said property of such owners, and the owners shall
pay the entire assessment when due.
(6) In the event a person so elects to pay such assess-
ment on or before November I, 1970, but fails to do so, the entire
amount of such assessment together with interest thereon from date
hereof to December 31, 1970, at the rate of six (6%) per cent per
annum, which shall be entered on the tax roll for the year 1969
and collected as are other taxes of the City, on a ten year in-
stal lment basis.
(7) After the time for making such election shall have
expired, such assessment shall be due and payable in installments
as aforesaid, but any assessment may be paid in full before due
only upon the payment of interest to date of prepayment upon such
assessment plus one year‘s interest on the then unpaid principal
amount of such assessment. 0

I, the undersigned, owner of property benefited by e the fol lowing proposed pub I ic improvement to be made by the City
of Muskego, Waukesha County, Wisconsin, to-wit: The installation
of an eight-inch sanitary sewer main, in consideration of the con-
struction of said improvement by the City of Muskego, Wisconsin,
hereby admit that such public improvement would benefit my pro-
perty and consent to the levying of a special assessment against
said property under Section 66.60 of the Wisconsin Statutes for
the cost of such improvement. e In accordance with Section 66.60 (18) of the Wisconsin
Statutes, I hereby waive all special assessment notices and hearing
required by Section 66.60 Wisconsin Statutes, and further agree and
admit that the benefit to my property from the construction of such
improvement equals the cost thereof, the cost of the main as assessed,
installation of a sewer lateral and attorneys fees.
