RESOLUTION #83-69
APPROVAL OF SEWER EASEMENT BETWEEN
THADDEUS O'GRADY AND CITY OF MUSKEGO
BE IT RESOLVED that the attached easement between the
City of Muskego and Thaddeus O'Grady be approved and that the
Mayor and City Clerk be authorized to execute same on behalf
of the City.

EASEMENT
THIS INDENTUNRE is made this /o day of
and between the CITY OF MUSKEGO, a municipal corpo a-L, ation, Grantor, ,1969, by
and THADDEUS O‘GRADY, Grantee.
For and in consideration of the conditions and covenants herein
contained the City does grant and convey unto the Grantee, his heirs,
successors and assigns, an easement for the construction, operation,
use, maintenance and repair of a sanitary sewer lateral over the
following described real estate, to-wit: *
Commencing at a point where the North-South Quarter line of
Section 16, Town 5 North, Range 20 East, and the South Boundary
line of the Thaddeus O‘Grady property intersect; thence
Easterly along the South boundary line of the O’Grady property
67 feet to the point of beginning; thence Southerly and parallel
with the North-South quarter line 25 feet to the location of an
existing 42 inch sanitary sewer main; thence Easterly 10 feet;
thence Northerly and parallel to the North-South quarter line
25 feet to the South line of the O’Grady property; thence
Westerly along said line to the point of beginning.
It is intended hereby to grant an easement 10 feet in width
over the North 25 feet of a sewer easement granted the City
of Muskego by one Otto Hohensee.
It is an express condition of the granting of this easement
that the condition of the property of the City over which this
easement is granted, and the lateral of the Grantee installed, will
be maintained in substantially the same condition as exists prior
to the installation of said lateral. The City reserves to itself
the right to make such use of the land included in said easement as
will not disturb or interfere with such easement or prevent ingress
or egress thereto for purposes of the easement.
The Grantee, his heirs, successors and assigns, shall be re-
sponsible for all damages that may result from his use of the rights
granted by this easement. It is expressly understood between the
parties that this easement is not to be permanent, but exists at the
pleasure of the City, its successors and assigns. The easement may
be terminated upon 30 days written notice to the Grantee, his heirs,
successors or assigns.
