CCR2010022-Attachment WISCONSIN PROFESSIONAL POLICE ASSOCIATION LAW ENFORCEMENT EMPLOYEE RELATIONS DIVISION GRIEVANCE FORM Grievance No: 10-134 Date of Grievance: January 25, 2010 WPPA/LEER Local: Muskego Police Association, Local # 360 Name of Grievant: Tim Esser Contract Sections Violated (including, but not limited to): Article 7 – Hours and Workweek, Section 1 B, The normal workday consists of eight (8) consecutive duty hours including one-half (1/2) hour lunch break, subject to call, and shall be preceded by fifteen (15) minutes of report-in time, for a total of eight and one- quarter (8¼) hours. Article 7 – Hours and Workweek, Section 1 E, Any flexing of normal duty hours shall be on a mutually agreed upon basis between the employee and the shift/bureau commander/supervisor. The flexing of normal duty hours includes the following: changing the starting and ending times of the shift. Article 19 – Management Rights Reserved, Section 1, Unless otherwise herein provided, the management of the work and the direction of the working forces, including the right to hire, promote, demote, or suspend or otherwise discharge for proper cause and the right to relieve employees from duty because of the lack of work or other legitimate reason is vested in the Employer. Describe the Grievance: Did the City violate the collective bargaining agreement when it ordered Tim Esser to end his normal work shift early? Remedy for Grievance: Make the employee whole for any lost overtime or compensatory time required to keep Tim Esser in a paid status when ordered to leave.
